[value] => Ende März hat der Bundestag eine Reform des 65 Jahre alten Mutterschutzgesetzes beschlossen, welchem auch der Bundesrat zugestimmt hat. Das Gesetz tritt Anfang 2018 in Kraft. Im Folgenden werden die wesentlichen Änderungen vorgestellt:
Nach der bisher geltenden Gesetzesfassung gilt der gesetzliche Mutterschutz nur für Arbeitnehmerinnen und Heimarbeiterinnen. Das neue Gesetz weitet den Personenkreis aus, sodass künftig alle Frauen, die in einer Beschäftigung iSv. § 7 Abs. 1 SGB IV stehen, unter das Gesetz fallen. Dazu gehören u.a. nun auch Fremdgeschäftsführer einer GmbH, Auszubildende, Praktikanten, Schüler und Studenten.
Die gesetzlichen Schutzfristen von 6 Wochen vor der Entbindung und von 8 Wochen danach sind dem Grunde nach unverändert geblieben. Eine verlängerte Schutzfrist findet nun nicht nur im Fall von Früh- und Mehrlingsgeburten Anwendung, sondern auch, wenn eine Behinderung des Kindes festgestellt wird. Eine Ausnahme vom Beschäftigungsverbot ist jedoch möglich, wenn bspw. eine Studentin eine wichtige Klausur schreiben möchte.
Darüber hinaus soll es gegen den Willen der Schwangeren keine Arbeitsverbote mehr geben. Sprich, wer arbeiten möchte, kann dies tun und wird nicht zwangsweise beurlaubt. Auch die Möglichkeit der Sonn- und Feiertagsarbeit sowie die Arbeit zwischen 20 und 22 Uhr soll erweitert werden, sofern die Betroffene dies möchte.
Der besondere Kündigungsschutz, Kündigungsverbot während der Schwangerschaft und bis zum Ablauf von 4 Monaten nach der Entbindung, bleibt bestehen, wird aber dahingehend ausgeweitet, dass nun auch Frauen erfasst sind, die nach der 12. Schwangerschaftswoche eine Fehlgeburt erleiden.
Um den Arbeitsschutz zu verbessern, sollen Arbeitgeber künftig für jeden Arbeitsplatz eine anlassunabhängige Gefährdungsbeurteilung vornehmen, sprich unabhängig wer dort arbeitet und ob eine Mitarbeiterin schwanger ist. Jeder Arbeitsplatz soll daraufhin überprüft werden, ob hier besondere Schutzbedürfnisse für Schwangere oder stillende Frauen bestehen.

[value] => A finales de marzo el Bundestag aprobó la reforma de la Ley sobre la protección de la maternidad de 1952. La nueva Ley entrará en vigor a principios de enero de 2018. A continuación se presentan las principales novedades:
La Ley actual se refiere únicamente a las empleadas del hogar. La nueva Ley amplía su ámbito de aplicación a todas mujeres empleadas en el sentido del § 7 párr. 1 SGB IV (libro social IV de Alemania), incluidas, entre otras, directoras generales extranjeras de sociedades limitadas, aprendices, becarias y estudiantes.
El período de protección antes y después del parto, de 6 y 8 semanas respectivamente, permanece invariable. Como novedad, el texto reciente-mente aprobado prevé la posibilidad de ampliar dicho período no solo en caso de parto prematuro o embarazo múltiple, sino también en caso de discapacidad del recién nacido. Asimismo, se contemplan excepciones a la prohibición general de trabajar, por ejemplo, en caso de que una estudiante tenga que presentarse a un examen.
Sin embargo, la nueva Ley suprime la prohibición de trabajar para las mujeres que lo soliciten, que podrán seguir desempeñando su actividad laboral sin excedencia forzosa. Se contempla también la posibilidad de trabajar en domingos y festivos, así como entre las 20 y 22 horas, si la trabajadora lo desea.
Se mantiene la protección especial contra el despido, es decir, la prohibición de despedir durante el embarazo y los 4 meses después del parto, con la salvedad de que ahora también afecta a las mujeres que pierdan a sus bebés después del tercer mes de vida.
Para mejorar la protección laboral el empleador deberá ahora realizar una valoración de riesgos para cada puesto de trabajo independientemente de quien lo ocupe y de si la empleada está embarazada o no. Deberá comprobarse si cada puesto de trabajo requiere una protección especial para embarazadas o mujeres lactantes.
