[value] => Am 6. Juni 2017 wurde das Real Decreto 564/2017 (Königlicher Erlass) vom 2. Juni veröffentlicht, durch welches die Regelungen zum Energieeffizienz-Zertifikat (Real Decreto 235/2013 vom 5. April) geändert wurden. Das Energieeffizienz-Zertifikat ist ein offizielles Dokument, ausgestellt von einem zuständigen Fachmann, welches objektive Information über die Energiemerkmale eines bestehenden Gebäudes (oder selbstständiger Teile davon) enthält. Dies gilt sowohl für Gebäude und Räume, die als Wohnung genutzt werden, als auch für Büro- und Geschäftsflächen. Das Energieeffizienz-Zertifikat ist Voraussetzung für die Übertragung bzw. Vermietung der Immobilien, welche in den Anwendungsbereich über die Regelungen dazu fallen.
Die vorhergehende Norm sah gewisse Ausnahmen vom Erfordernis des Energieeffizienz-Zertifikates vor (beispielsweise bei Gebäuden mit besonderem historischem oder architektonischem Wert oder im Falle von Industriegebäuden). Jedoch haben sich diese Ausnahmen seit dem Inkrafttreten der Änderungen am 7. Juni 2017 verringert bzw. geschmälert. So wird nun bei ausgewiesenen Gebäuden mit besonderem historischem oder architektonischem Wert das Energieeffizienz-Zertifikat verlangt, es sei denn, dass die Maßnahmen zur Verbesserung der Energieeffizienz den Charakter oder das Erscheinungsbild auf eine unvertretbare Weise verändern. Ähnlich verhält es sich mit den Industriegebäuden. Während dies zuvor vollständig vom Anwendungs-bereich ausgenommen waren, und somit kein Energieeffizienz-Zertifikat benötigten, sind mit der neuen Regelung nur noch die Gebäude oder Teile davon ausgeschlossen, welche einen geringen Energiebedarf aufweisen. Gemäß der neuen Regelung sind dies Gebäude(teile), die die Sicherstellung eines thermischen Komforts nicht erfordern, wie beispielsweise Werk- oder Produktionshallen.

[value] => El pasado 6 de junio de 2017 se publicó el Real Decreto 564/2017, de 2 de junio, por el que se modifica el Real Decreto 235/2013, de 5 de abril, por el que a su vez se aprueba el procedimiento básico para la certificación de la eficiencia energética de los edificios. El certificado de eficiencia energética es un documento oficial redactado por un técnico competente que da información objetiva sobre las características energéticas de un edificio existente (o partes individuales de ello), ya sea una vivienda, oficina o local, que resulta imprescindible para su transmisión o bien su arrendamiento.
La anterior normativa preveía ciertas excepciones en las que no resultaba necesario aportar dicho certificado de eficiencia energética (por ejemplo, edificios protegidos por sus valores históricos o arquitectónicos, o edificios industriales, de la defensa y agrícolas no residenciales) pero desde el pasado 7 de junio, fecha en la que entró en vigor la arriba citada modificación, estas excepciones se han reducido algo más o, cuanto menos, matizado. Así, y en relación a los edificios protegidos por sus valores históricos o arquitectónicos, o que formen parte de un entorno declarado, el certificado de eficiencia energética sí será exigible salvo que las actuaciones de mejora de la eficiencia energética alteren de manera inaceptable su carácter o aspecto. Algo parecido sucede con los edificios industriales, de la defensa y agrícolas no residenciales. Mientras antes estaban por completo excluidos del ámbito de aplicación, y por tanto, no precisaban de certificado de eficiencia energética, bajo la nueva regulación solo estarán excluidos aquellos “de baja demanda energética”. La norma señala que se considerarán de baja demanda energética las zonas que no requieran garantizar unas condiciones térmicas de confort y a modo de ejemplo, señala las edificaciones destinadas a talleres y procesos industriales.
