[value] => Der nationale Gerichtshof (Audiencia Nacional) hat Ermittlungen gegen die chinesische Bank ICBC als juristische Person wegen fortgesetzter Geldwäsche krimineller chinesischer Banden, die in Spanien aktiv sind, aufgenommen. Der Beschluss vom September stützt sich darauf, dass die europäische Filiale der ICBC (Industrial and Commercial Bank of China) zwischen 2011 bis 2014 als „Geldwäschebank“ zur Durchführung diverser Handlungen durch verschiedene kriminelle Banden wie „Emperador“ und „Snake“ fungierte.
Der Ursprung der Untersuchungen geht auf die 2015 begonnene „Operation Snake“ zurück, bei der diverse leitende Angestellte des Bankinstituts untersucht wurden, wenngleich der Richter des nationalen Gerichtshofs erwägt, die Anklage auf die ICBC Luxemburg auszuweiten, da er meint, dass sie „punktuelle Kenntnis über die Art und Weise hatte, wie ICBC Spanien handelte“ und er außerdem der Auffassung ist, dass die leitenden Angestellten „im Rahmen der Befugnisse der ICBC Luxemburg und im ausschließlichen Interesse und für Rechnung des Bankinstituts ICBC Luxemburg“ handelten.
Die getätigten Transaktionen der Bank bestanden laut des Beschlusses darin, das Maximum der Bareinlagen der Kunden zu erlangen, die in Schattenwirtschaftsaktivitäten und verdächtigen Steuer- und Abgabenbetrugssachen verwickelt sind. Dazu erhöhte die Bank die Deckung ihrer Geldmittel mittels Aufteilung der Zahlungen sowie durch interne nicht benannte Konten, vorgetäuschte Rechnungen und durch massive Geldmittelsendung nach China. Der Richter fügt an, dass die Regelungen zur Verhinderung der Geldwäsche und Terrorismusfinanzierung nicht verabschiedet wurden und dass weder Kontrollprüfungen ausgeübt wurden noch für die Behörden verdächtige Transaktionsberichte bestanden.
Die Entscheidung des spanischen Richters ist dem Bankinstitut bereits durch ein Rechtshilfeersuchen mitgeteilt worden, das nach Luxemburg versandt wurde, wo es seinen steuerlichen Sitz hat.

[value] => La Audiencia Nacional ha decidido iniciar un procedimiento contra el banco chino ICBC como persona jurídica por un delito continuado de blanqueo de capitales de grupos criminales chinos activos en España. El Auto del mes de septiembre sostiene que la filial europea del ICBC (Industrial and Commercial Bank of China) actuó como “banco de blanqueo” mediante la realización de diversas operaciones, entre 2011 y 2014, con varios grupos criminales como el “Emperador” y “Snake”.
El origen de la investigación está en la ‘operación Snake’ iniciada en el 2015 donde ya se habían investigado a varios de los directivos de la entidad bancaria, si bien ahora el juez de la Audiencia Nacional considera que es posible extender la imputación a ICBC Luxemburgo pues cree que éste “tuvo un conocimiento puntual sobre la forma que operaba ICBC España” y además porque entiende que los directores han actuado “en el marco de los poderes concedidos por ICBC Luxembourg y en beneficio y por cuenta de la entidad ICBC Luxembourg.”
La operativa utilizada por el banco según lo expuesto en el Auto consistía en captar el máximo de depósitos en efectivo de clientes inmersos en su mayoría en actividades de economía sumergida y sospechosas de fraude fiscal y arancelario. Para ello, el banco aumentó la opacidad de sus fondos mediante el fraccionamiento de pagos y a través de cuentas internas innominadas del banco, utilizando documentación falsa, simulando facturas y mediante envíos masivos de fondos a China. El juez además añade que no se adoptaron las normas de prevención de blanqueo de capitales y financiación del terrorismo y que no se practicó ninguna comprobación de control, ni comunicación de operaciones sospechosas a las autoridades.
La decisión del juez español ya se ha notificado a la entidad a través de una comisión rogatoria enviada a Luxemburgo, donde tiene su domicilio fiscal.
