[value] => Der Bayerische Landtag hat am 30.05.2017 eine deutliche Verschärfung des bestehenden Gesetzes über das Verbot der Zweckentfremdung von Wohnraum beschlossen. Das Gesetz wird bereits als Airbnb-Gesetz bezeichnet, weil sich durch die Vermietung von Wohnraum an Touristen, Messegäste und Studenten über Online-Plattformen wie insbesondere Airbnb und Wimdu der angespannte Wohnungsmarkt in München weiter verschärft hat. Dies hat nun die Politik auf den Plan gerufen.
Nach dem neuen Gesetz gilt als Zweckentfremdung, wenn mehr als 50% Prozent der Gesamtfläche für gewerbliche oder berufliche Zwecke verwendet oder überlassen werden, der Wohnraum baulich so verändert wird, dass er nicht mehr für Wohnzwecke geeignet ist, mehr als 8 Wochen im Jahr zur Fremdenbeherbergung genutzt wird, länger als 3 Monate leer steht oder beseitigt wird. Zur Durchsetzung der neuen Vorschriften sind umfangreiche Auskunftspflichten der Wohnungseigentümer, Besitzer (insbesondere Mieter), Verwalter und Vermittler vorgesehen. Auch haben die Behördenvertreter das Recht, die Wohnungen zu betreten. Stellt die Behörde einen Verstoß gegen das Gesetz fest, kann sie anordnen, dass die Zweckentfremdung beendet und die Wohnung wieder Wohnzwecken zugeführt wird. Die Anordnungen sind sofort vollziehbar. Klagen hiergegen haben keine aufschiebende Wirkung. Wer dem Gesetz zuwiderhandelt, riskiert nunmehr eine Geldbuße von bis zu EUR 500.000 statt wie bisher EUR 50.000. Außerdem kann die Nichtbefolgung der Auskunftspflicht gesondert mit einer Geldbuße von EUR 50.000 geahndet werden. Angesichts der fehlenden Möglichkeit, Räumungen zu veranlassen, wird bezweifelt, dass das Gesetz zu einer Entspannung des Wohnungsmarkts in München beitragen kann. In jedem Fall sollte es von den Betroffenen berücksichtigt werden.

Algunos llaman a esta reforma la “Ley Airbnb”. Puesto que el alquiler de viviendas a turistas, asistentes a congresos y estudiantes a través de plataformas como Airbnb y Wimdu ha tensado aún más la ya de por sí complicada situación del mercado de viviendas en Múnich, los políticos han tenido que reaccionar.
La nueva legislación considera que existe un “uso indebido” de una Vivienda en cuanto se destina o cede más de un 50% de su superficie total a fines comerciales o profesionales, se modifica constructivamente de tal manera que no puede usarse para fines habitacionales, se destina más de 8 semanas al año al alojamiento de desconocidos, se encuentra vacía durante más de 3 meses o cuando se elimina. Para implementar efectivamente esta reforma, la ley impone al propietario, gestor, arrendatario o intermediario de una vivienda, amplios deberes de información frente a la administración. Los inspectores de la administración podrán también acceder a la propia vivienda. Si detectan una infracción, podrán ordenar que se ponga fin al uso indebido del inmueble y que éste vuelva a usarse como vivienda. Esta orden es ejecutable inmediatamente. La cuantía máxima de la multa se ha multiplicado por diez, alcanzando ahora los 500 000 €. Además, se podrá multar con hasta 50 000 € a quién no cumpla los requerimientos de información por parte de la administración. Sin embargo, la Ley no contempla la posibilidad de desalojar la vivienda, por lo que se duda de que rebaje la tensión del mercado de la vivienda en Múnich. En cualquier caso los afectados deberán tenerla en cuenta.
