[value] => Die Generaldirektion für Abgaben (“DGT”) erklärt in ihrer Rechtsauskunft V2425/2016 vom 03.06.2017, dass der Aufwand, der auf dem Rücklagenkonto eines späteren Geschäftsjahres aufgrund der Abschreibung in Vorjahren verbucht wurde, dann steuerlich abzugsfähig ist, wenn er keinem verjährten Geschäftsjahr entspricht.
Diese Feststellung erfolgt unter Berufung auf Artikel 11.3 des Körperschaftsteuergesetzes („LIS“), der besagt, dass die Zurechnung von Aufwendungen, die buchmäßig in der Gewinn-und-Verlust-Rechnung oder einem Rücklagenkonto während eines späteren Veranlagungszeitraums als jenem, in dem deren temporäre Zurechnung begründet wäre, in Ansatz gebracht werden, in dem Veranlagungszeitraum vorzunehmen ist, in dem die buchmäßige Zurechnung erfolgt ist, solange hieraus keine niedrigere Besteuerung resultiert.
Für die Einschätzung solch einer niedrigeren Besteuerung, dürfen die möglichen Auswirkungen einer Verjährung nicht außer Acht gelassen werden. So ist etwa zu berücksichtigen, dass aus einem verjährten Steuerjahr stammende und in einem späteren Jahr verbuchte Aufwendungen, gemäß Art. 11.1 LIS jenem Steuerjahr zugerechnet werden können, in dem die Verjährung deren Abzug untersagt. Was im Umkehrschluss bedeutet, dass Aufwendungen, die einem nicht verjährten Steuerjahr entsprechen, in Abzug gebracht werden dürfen.

[value] => La DGT en su consulta V2425/2016 de 03.06.2017 establece que el gasto contabilizado en la cuenta de reservas en un ejercicio posterior por la amortización de ejercicios anteriores, será fiscalmente deducible en la medida en que no corresponda a un ejercicio prescrito.
Se basa para ello en el artículo 11.3 de la LIS que establece que los gastos imputados contablemente en la cuenta de P y G o en una cuenta de reservas en un período posterior a aquel en el que proceda su imputación temporal, la misma se efectuará en el período impositivo en el que se haya realizado la imputación contable, siempre que de ello no se derive una tributación inferior.
Al efecto de valorar la posible tributación inferior, debe tenerse en cuenta el posible efecto de la prescripción. Así, gastos procedentes de un ejercicio prescrito contabilizados en un ejercicio posterior supone que dichos gastos se imputen, de acuerdo con la regla general del artículo 11.1 de la LIS, a aquél ejercicio, en el que la prescripción impide su deducción. A sensu contrario si los gastos corresponden a un ejercicio no prescrito se podrán deducir.
