[value] => In einem Gerichtsbescheid vom 14.03.2017 hat das Finanzgericht Köln (2 K 920/14) entschieden, dass der Betrieb von Windrädern im Inland durch eine Gesellschaft ausländischen Rechts auch dann eine inländische Betriebsstätte im Sinne von § 13b Abs. 7 UStG begründet, wenn bei den Windkraftanlagen kein eigenes Personal tätig ist.
Bei Windrädern handelt sich um ortsfeste Einrichtungen von erheblichem Wert, die einen höchstmöglichen Grad von Beständigkeit aufweisen. Dass die Gesellschaft über kein eigenes Personal verfügt, welches ständig vor Ort bei den Windkraftanlagen tätig ist, stehe der Annahme einer festen Niederlassung bzw. Betriebsstätte angesichts der Gesamtumstände nicht entgegen. Zwar ist grundsätzlich auch die personelle Ausstattung ein wesentliches Element einer Betriebsstätte. Dies bedeutet jedoch nicht, dass die Kriterien der personellen und der technischen Ausstattung stets im gleichen Maße erfüllt sein müssen. Vielmehr kann eine gering ausgeprägte – oder in Ausnahmefällen sogar fehlende – personelle Ausstattung durch eine überdurchschnittlich stark ausgeprägte sachliche Ausstattung kompensiert werden, was bei einer Windkraftanlage der Fall sei. Bei einer ortsfesten Betriebsvorrichtung, die – wie im Streitfall – ohne Zutun von Personal Umsätze erbringt, sei für die Frage der Ansässigkeit eines Unternehmens nicht auf das Vorhandensein von eigenem Personal abzustellen. Vielmehr reiche in einem solchen Fall die Beauftragung von Fremdpersonal, etwa – wie im Streitfall – für die Durchführung von Wartungsarbeiten, aus.
Im Ergebnis befinde sich damit der Sitz der wirtschaftlichen Tätigkeit der ausländischen Gesellschaft im Inland, so dass diese kein ausländisches Unternehmen sei und damit das besondere Vorsteuervergütungsverfahren gemäß § 18 Absatz 9 UStG in Verbindung mit §§ 59 ff. UStDV nicht anwendbar sei. Der Fall zeigt, dass auch durch ein weitgehendes Outsourcing von Personalfunktionen - zumindest für Zwecke der Umsatzsteuer - eine inländische Betriebstätte nicht vermieden werden kann.

[value] => En una sentencia abreviada del 14/03/2017, el Tribunal de lo Fiscal de Colonia (2 K 920/14) decidió que la explotación de molinos de viento en Alemania por medio de una sociedad extranjera también califica como establecimiento permanente en Alemania en el sentido del § 13b (7) LIVA alemana, también cuando en las instalaciones eólicas no trabaje su propio personal.
Los molinos de viento consisten en equipos fijos de considerable valor, que muestran un mayor grado posible de continuidad en el tiempo. Si la sociedad no dispone de personal propio que realice su trabajo continuamente en el lugar donde se encuentran las instalaciones eólicas, no obsta para la consideración de un lugar fijo de negocios o de un establecimiento permanente a la vista de las demás circunstancias. Aunque la presencia de personal generalmente también sea un elemento esencial de un establecimiento permanente no determina que los criterios de recursos humanos y técnicos deban cumplirse siempre en la misma proporción. Al contrario, una plantilla limitada –o en casos excepcionales, incluso una falta de personal -puede compensarse con un equipamiento excepcional, siendo aquí el caso de los molinos de viento. Así al ser una instalación operativa fija –como se puso en controversia-que proporciona ingresos sin intervención de personal, la cuestión de la residencia de una empresa no debe orientarse según la existencia del propio personal. Es suficiente para ello contratar personal externo para realizar el mantenimiento.
En consecuencia, la sede de la actividad económica de la sociedad extranjera se encuentra en Alemania, de modo que no se trataría de una empresa extranjera y no procedería a la aplicación del procedimiento especial de devolución del IVA deducible de conformidad con el § 18 (9) LIVA alemana y los §§ 59 y ss RIVA alemán. El caso muestra que también mediante una externalización de gran parte de las funciones del personal –por lo menos a efectos del IVA- no puede evitar la constitución de un establecimiento permanente en Alemania.
