[value] => Die Zuständigkeit im Zivilverfahren in der ersten Instanz hängt vom Streitwert ab. Bis zu 5.000,00 € sind die Amtsgerichte zuständig, bei Streitwerten darüber die Landgerichte. Schon seit längerer Zeit folgen Unternehmen der Tendenz, Streitigkeiten des Wirtschaftsrechts von privaten Schiedsgerichten entscheiden zu lassen. Als Grund für die Abwanderung zu den Schiedsgerichten wird neben vielen anderen Gründen häufig die Freiheit bei der Wahl der Schiedsrichter genannt. Damit lassen sich auf einfache Art und Weise anerkannte Spezialisten für bestimmte Gebiete als Schiedsrichter finden.
Bei den Landgerichten fehlt dieser hohe Spezialisierungsgrad häufig. Zwar existieren an den meisten Landgerichten sog. Kammern für Handelssachen. Alle anderen Gebiete werden aber gemeinsam von den restlichen Zivilkammern behandelt. Der Gesetzgeber will das nun ändern und richtet ab 01. Januar 2018 obligatorische Spezialkammern an den Landgerichten ein. Diese sollen für vier Gebiete geschaffen werden: (1) Bank- und Finanzgeschäfte, (2) Bau- und Architektenverträge, (3) Ansprüche aus Heilbehandlungen und (4) Versicherungsvertragsverhältnisse. An den Oberlandesgerichten sollen entsprechende Senate eingerichtet werden. Beim Bundesgerichtshof sind bereits alle zwölf Zivilsenate (zzgl. weiterer Spezialsenate) thematisch unterteilt. So entscheidet beispielsweise der siebte Zivilsenat über Streitigkeiten aus Handelsvertreterverträgen.
Die fortschreitende Spezialisierung der staatlichen Gerichte in Deutschland ist eine gute Nachricht. Weiterhin in der Schwebe bleibt allerdings die Einrichtung von speziellen Kammern für internationale Handelssachen, die auch auf Englisch verhandeln können sollen (AHK-Newsletter „Recht & Steuern“, 09/2014, S. 11). In Fällen mit Auslandsbezug muss nicht nur deshalb nach wie vor sehr behutsam zwischen einer Gerichtsstandsvereinbarung (staatliche Gerichte) und einer Schiedsvereinbarung abgewogen werden.

Hasta 5.000,00 € son los “Amtsgerichte” y para cuantías superiores son los “Landgerichte”. Desde ya hace tiempo muchas empresas siguen la tendencia de someter los litigios de derecho mercantil a los Tribunales arbitrales privados. Entre otras, la razón de esta migración a los Tribunales arbitrales es con frecuencia la libertad de elección de árbitro. De esta forma se pueden fácilmente encontrar árbitros que son especialistas en ciertas áreas de derecho.
A menudo, en los Juzgados de Primera Instancia (“Landgerichte”) suele faltar este alto grado de especialización. En la mayoría de ellos existen, no obstante, las llamadas salas para asuntos comerciales. El resto de materias son tratadas juntamente en las demás salas civiles. El legislador quiere cambiar esto y está preparando salas especiales obligatorias a partir de 2018 en todos los Juzgados de Primera Instancia. Estas salas se dividirán en cuatro áreas: (1) actividades bancarias y financieras, (2) contratos de construcción y arquitectura, (3) reclamaciones por tratamientos médicos y (de 4) relaciones en los contratos de seguro. En los Tribunales Regionales Superiores están ya todas las doce salas de lo civil (además de otras salas especiales) subdivididas por temas. Así pues, por ejemplo, la séptima sala de lo civil decide en litigios sobre contratos de agencia.
La especialización progresiva de los tribunales alemanes es una buena noticia. Sin embargo queda aún en el aire la creación de salas especiales para asuntos mercantiles internacionales que pueden ser tratados en inglés. En casos transfronterizos no sólo debe seguir valorándose, por ello, entre el adoptar un acuerdo de jurisdicción competente (tribunales estatales) y un acuerdo de arbitraje.
