[value] => Art. 140 GG i.V.m. Art. 137 Abs. 3 WRV räumt allen Religionsgesellschaften das Recht ein, selbstbestimmt und ohne staatliche Aufsicht über ihre eigenen Angelegenheiten zu entscheiden. Eine der wichtigsten Ausprägungen betrifft das kirchliche Dienst-und Arbeitsrecht.
Die kath. Kirche in Deutschland hat von der ihr eingeräumten Regelungsautonomie im Bereich des Kollektivarbeitsrechts Gebrauch gemacht. In kirchlichen Betrieben regeln grds. aus Dienstgebern und Dienstnehmern paritätisch besetzte Kommissionen die Fragen des Tarifrechts. Mit dem sog. Dritten Weg legen die verfassten Kirchen die Grundbedingungen des Arbeitsverhältnisses in allgemeinen Richtlinien/Ordnungen fest. Diese Haltung ist begründet in dem Verständnis des kirchlichen Dienstes als Dienstgemeinschaft, die eine Tarifauseinandersetzung ausschließt. In der „Grundordnung des kirchlichen Dienstes im Rahmen kirchlicher Arbeitsverhältnisse“ heißt es knapp und deutlich: „Streik und Aussperrung widersprechen den Grunderfordernissen des kirchlichen Dienstes.“
Das BAG hat in einem Urteil 2012 den Dritten Weg der Kirchen bestätigt, gleichzeitig aber das Streikverbot gelockert. Es erkennt dem kirchlichen Selbstbestimmungsrecht keinen absoluten Vorrang zu, sondern stellt ihm die von Art. 9 Abs. 3 GG geschützte Koalitionsfreiheit der Gewerkschaften entgegen (praktische Konkordanz).
In evangelischen Einrichtungen hat es seit dem BAG-Urteil in den vergangenen Jahren Streiks gegeben, nicht aber in katholischen. Im Saarland haben nun erstmals ca. zwanzig Mitarbeiter eines kath. Krankenhauses am 11.10.2017 die Arbeit niedergelegt. Sie fordern bessere Arbeitsbedingungen in der Pflege. Der Geschäftsführer der Marienhausklinik ließ offen, ob den Streikenden eine Abmahnung drohe. Der Dienstgeber, die Arbeitsrechtliche Kommission der Caritas, kritisierte den Streikaufruf als verantwortungslos.
Es bleibt abzuwarten, ob der Streik in der Marienhausklinik zum Präzedenzfall wird oder ob es bei diesem einmaligen Fall bleibt.

[value] => El art. 140 de la constitución alemana (GG) junto con el art. 137 párrafo 3 del Weimarer Reichsverfassung (ant. constitución de Weimar) otorga a todas las sociedades religiosas el derecho a decidir sobre sus propios asuntos sin la necesidad de supervisión estatal. Una de las características más importantes es el derecho disciplinario y laboral eclesiástico.
La iglesia católica en Alemania ha hecho uso de la autonomía reguladora que tiene otorgada en términos de derecho laboral colectivo. En las comunidades religiosas, quienes fundamentalmente regulan los contratos de trabajo son –en partes iguales- los comités compuestos por prestadores de servicios y los contratantes. Las condiciones básicas de la relación laboral están establecidas en la llamada “Tercera Vía”. Esta actitud se fundamenta en la comprensión del servicio eclesiástico como una comunidad de servicio, que excluye cualquier polémica en relación con los convenios colectivos. En el “orden básico del servicio eclesiástico dentro de un marco de las relaciones laborales eclesiásticas”, se dice claro y conciso que “la huelga y el cierre patronal son contradictorios a los requisitos básicos del servicio eclesiástico”.
El Tribunal Federal de Trabajo (BAG) confirmó en un juicio en 2012 la “Tercera Vía” de las iglesias, aunque al mismo tiempo se mostró más laxo con la prohibición de huelga. No reconoce que la autodeterminación de la Iglesia sea una prioridad absoluta, sino que pondera la libertad de coalición de los sindicatos dispuesto en el Art. 9 párr. 3 del GG.
En las instituciones protestantes ha habido en los últimos años huelgas desde la sentencia del BAG, no así en las instituciones católicas. El 11.10.2017, por primera vez, en Sarre aprox. 20 empleados de un hospital católico han abandonado su trabajo, exigiendo mejores condiciones de trabajo en el ámbito de la enfermería. El gerente de la clínica “Marienhausklinik” no dejó claro si los huelguistas recibieron una advertencia. El empleador, la Comisión de Empleo de Caritas, criticó la huelga como irresponsable.
Queda por ver si esta huelga constituirá un precedente o si permanecerá como un caso singular.
