[value] => Eine im Rahmen von Steuerprüfungen häufig umstrittene Frage stellt die Abzugsfähigkeit von Transport-, Hotel- und Restaurantdienstleistungen etc. im Rahmen der IVA dar. Ihre Nutzung zu privaten Zwecken ist dabei nicht gestattet (z. B. Aufmerksamkeiten an Kunden oder Angestellte, Reisen oder Essen leitender Angestellter etc.). Das IVA-Gesetz bestimmt darüber hinaus, dass, damit diese Dienstleistungen im Rahmen der IVA abzugsfähig sind, sie auch im Rahmen der spanischen Einkommen (IRPF)- oder Körperschaftsteuer (IS) abzugsfähig sein müssen.
Dieses zunächst trivial erscheinende Thema ist nun sogar bis vor das zentrale spanische Finanzgericht gelangt (TEAC), da der Leiter der spanischen Steuerverwaltung (AEAT) Rechtsmittel gegen die Entscheidung des Finanzgerichts von Katalonien (TEAR) eingelegt hatte. Dieses Gericht war davon ausgegangen, dass es für die Verneinung der Abzugsfähigkeit der genannten Dienstleistungen bezüglich der IVA seitens der Steuerbehörde nicht ausreiche, dass die entsprechenden Kosten im Rahmen der IRPF oder IS nicht abzugsfähig sind. Darüber hinaus sollte erforderlich sein, dass die Verwaltung die Abzugsfähigkeit der Reise- und Hotelkosten etc. im Zuge einer “separaten” Steuerprüfung abgelehnt hat. Allerdings hat das TEAC zugunsten der Verwaltung entschieden: Ausreichend ist der Nachweis im Rahmen einer Steuerprüfung ausschließlich für die IVA-Steuer, dass die Voraussetzungen für ihre Abzugsfähigkeit im Rahmen der IRPF oder IS nicht gegeben sind.
Es ist daran zu erinnern, dass die allgemeine Voraussetzung für die Abzugsfähigkeit der vorgenannten Kosten darin liegt, dass diese mit der ausgeübten Tätigkeit und der Erzielung von Einnahmen in Verbindung stehen.

[value] => Una de las cuestiones que suele ser objeto de controversia en el curso de las comprobaciones fiscales es la deducción en el IVA por los servicios de desplazamiento, viajes, hostelería, etc., pues no se permite su disfrute para fines privados (p.ej. atenciones no permitidas a clientes o asalariados, viajes o comidas de directivos, etc.). El Art. 96 del IVA establece además que para que se reconozca la deducibilidad del IVA en la adquisición de los mencionados servicios, estos también deben ser deducibles en el IRPF o el IS.
Este asunto - que parece a primera vista trivial - ha llegado al Tribunal Económico Administrativo Central (TEAC) en recurso presentado por el mismo Director de Gestión Tributaria de la AEAT contra una resolución del TEAR de Cataluña. Este Tribunal consideró que no bastaba con que no fueran fiscalmente deducibles los gastos correspondientes en el IRPF o IS, para negar su deducibilidad en el IVA sino que además, era necesario que la Administración hubiera regularizado dichos gastos de viajes, hostelería, etc., en estos impuestos. Pues bien, el TEAC ha fallado a favor de la Administración y niega que ésta tenga que regularizar la no deducibilidad de los gastos en el IS o IRPF, para que no se admita su deducibilidad en el IVA. Es decir, le bastará con acreditar en una comprobación por IVA, que objetivamente no se cumplen los requisitos para reconocer su deducibilidad en la imposición directa.
Recordemos que los requisitos de deducción son en general que los gastos estén relacionados con la actividad desarrollada y con la obtención de ingresos. Además, en el IVA, siempre se requerirá que dichos gastos estén justificados mediante factura.
