[value] => Das Landgericht Berlin hat in seinem Beschluss vom 14.09.2017 darauf hingewiesen, dass es die sogenannte Mietpreisbremse für verfassungswidrig hält. Danach dürfen Mieten bei der erneuten Vermietung einer Wohnung in einem Gebiet mit einem angespannten Wohnungsmarkt nur maximal 10% über der ortsüblichen Vergleichsmiete liegen.
Das Gericht sieht darin einen Verstoß gegen das aus dem Grundgesetz folgende Gleichbehandlungsgebot. Insbesondere würden Vermieter in Berlin etwa gegenüber Vermietern in München benachteiligt, weil die Vergleichsmiete in Berlin über 70% geringer sei als in München. Das Gesetz hindere Vermieter in Berlin aber ebenso wie Vermieter in München an einer Erhöhung der Miete. Dabei seien die Verhältnisse in Berlin nicht mit denen in München vergleichbar, so dass sich eine Gleichbehandlung verbiete.
Außerdem würden solche Vermieter ungerechtfertigt besser gestellt, die von Anfang an eine überdurchschnittliche Miete verlangen. Denn diese hätten gar kein Bedürfnis, die Miete weiter zu erhöhen und könnten ganz im Gegenteil weiterhin die (überdurchschnittliche) Miete verlangen.
Angesichts dieser Entscheidung wird es spannend sein, zu sehen, wie andere Gerichte die Verfassungsmäßigkeit der Mietpreisbremse beurteilen und ob es hierzu eine Entscheidung des Bundesverfassungsgerichts geben wird.
In jedem Fall zeigt die Entscheidung, dass die in Deutschland seit der Einführung der Mietpreisbremse anhaltenden Diskussionen nunmehr auch eine Fortsetzung in der Rechtsprechung gefunden haben.
Da das Landgericht Berlin hier aber keine Entscheidung des Bundesverfassungsgerichts eingeholt hat, steht die Mietpreisbremse zunächst nicht zur Disposition und Vermieter sind weiterhin daran gebunden.

[value] => El 14 de septiembre de 2017, el Tribunal Regional de Berlín señaló que en su opinión el llamado “freno a la subida de los precios del alquiler” (Mietpreisbremse) es inconstitucional. Según esta ley, los precios del alquiler de los nuevos contratos de alquiler de viviendas no podrán superar el 10% del índice de referencia de las rentas de alquiler del lugar.
El tribunal considera que la ley vulnera el principio de igualdad de trato de la constitución alemana. Sobre todo para los arrendadores en Berlín que resultan desfavorecidos, al estar el alquiler medio del mercado en Berlín un 70% más bajo que, por ejemplo, la renta en Múnich. No obstante, la ley impide a los arrendadores en Berlín, al igual que en Múnich, aumentar la renta, aunque la situación en Berlín no es comparable con la de Múnich.
Además, el Tribunal opina que la ley favorece injustamente a los arrendadores que, desde el principio, cobran rentas que superan el alquiler medio del mercado. A ellos no les hace falta incrementar los precios, sino que siguen cobrando rentas más altas.
Considerando esta decisión será interesante ver, cómo otros tribunales evalúan la constitucionalidad del freno a la subida de los precios del alquiler. Sobre todo, queda esperar si habrá una decisión del Tribunal Constitucional que se refiera a este tema.
De todos modos, la decisión del Tribunal Regional de Berlín muestra que los debates que hay en Alemania desde la introducción del freno a la subida de los precios del alquiler ahora continúan en la jurisprudencia.
En el presente caso, el Tribunal en Berlín no ha solicitado una decisión del Tribunal Constitucional. Por lo tanto y hasta que llegue una decisión del Tribunal Constitucional, el freno a la subida de los precios del alquiler permanecerá en vigor.
