[value] => Die Arbeitnehmerüberlassung (AÜ) wird in Deutschland im Arbeitnehmerüberlassungsgesetz (AÜG) geregelt. Kern dieses Gesetzes ist, dass AÜ nur mit einer behördlichen Verleihererlaubnis betrieben werden darf. Synonym zur Arbeitnehmerüberlassung stehen die Begriffe „Zeitarbeit“ und „Leiharbeit“.
Um Missbrauch (überlange Einsätze der Leiharbeitnehmer) zu vermeiden und die Rechtssicherheit/Stellung der Leiharbeitnehmer, sowie die Transparenz zu verbessern und das Instrument AÜ für Personaleinsätze weiterhin zu gewährleisten war eine Neuregelung notwendig geworden, die nun zum 01. April 2017 in Kraft getreten ist.
Inhaltliche Änderungen zum AÜG:
- Überlassungshöchstdauer – das bisherige Kriterium von „vorübergehend“ wird grundsätzlich auf 18 Monate festgelegt (Tarifverträge können dies abändern)
- Equal Pay (Grundsatz der Gleichstellung) – Leiharbeitnehmer haben nun nach 9 Monaten ein Recht auf Bezahlung wie vergleichbare Stammarbeitnehmer im Betrieb (auch dies können TV auf bis zu 15 Monate ausdehnen)
- Streikbrecherverbot: Leiharbeitnehmer dürfen nicht in Entleiherbetrieben tätig werden, die unmittelbar vom Arbeitskampf betroffen sind
- Schwellenwerte: Leiharbeitnehmer müssen mitgezählt werden im Entleiherbetrieb
- Offenlegung der AÜ: im Überlassungsvertrag zwischen Ent- und Verleiher müssen die einzelnen Arbeitnehmer konkretisiert werden und dürfen nicht als Arbeitskraftskontingente verliehen werden
- Verbot des Kettenverleihs
- Wegfall der statistischen Meldepflichten für Verleiher
Der Verleiher muss als Arbeitgeber des Leiharbeitnehmers die allgemeinen Regelungen des Arbeits- und Sozialrechts, also auch des AÜG inklusive der Neuregelungen beachten – Verstöße können als Ordnungswidrigkeit für Ver- und Entleiher mit hohen Bußgeldern geahndet werden und dem Verleiher kann bei schwerwiegenden Verstößen die Verleihererlaubnis entzogen werden.
Die Bundesagentur für Arbeit und die Zollverwaltung (Finanzkontrolle Schwarzarbeit) kooperieren bezüglich Verdachtsfällen und führen gemeinsame Prüfungen durch.

[value] => La cesión de trabajadores por las empresas de trabajo temporal debidamente autorizadas por la autoridad laboral se regula en Alemania por la ley “Arbeitnehmerüberlassungsgesetz (AÜG)“.
Para evitar abusos (de duración prolongada de los trabajadores cedidos), para mejorar la situación legal de los trabajadores cedidos, la transparencia de la cesión y para seguir garantizando la herramienta de la cesión de personal surgió la necesidad de actualizar y modificar la citada ley. Las modificaciones entraron en vigor el 01 de abril de 2017.
Contenido:
- Duración máxima de la cesión de personal – el requisito „duración temporal“ se delimita ahora a 18 meses (los convenios pueden ampliar/ recortar el plazo)
- Equal Pay (Principio de Igualdad) – los trabajadores cedidos tienen el derecho a retribuciones iguales a los trabajadores fijos en puestos comparables de la empresa una vez pasado 9 meses (los convenios pueden ampliar a 15 meses)
- Prohibición de esquiroles: los trabajadores cedidos no pueden ejercer trabajos en empresas que actualmente estén en una situación de huelga.
- Especificación de cantidades: los trabajadores cedidos cuentan como trabajadores fijos en la empresa destino
- Transparencia de la cesión: en el contrato de cesión entre la ETT y empresa destino hay que nombrar individualmente a cada trabajador con su nombre, no es suficiente acordar solo un número (contingente) de trabajadores
- Prohibición de cesión temporal encadenada
- Eliminación de la obligación de la ETT de la notificación estadística
La ETT tiene que cumplir como empresario del trabajador temporal con la legislación laboral y social, incluyendo la ley sobre la cesión temporal (AÜ en Alemania) – las infracciones se sancionarán como faltas administrativas con multas muy altas y en casos de faltas graves la ETT puede perder su licencia.
La Agencia Federal de Empleo y la oficina de aduanas cooperan ante casos sospechosos y llevan a cabo las acciones de inspección.
