[value] => Der BFH hat entschieden (14-07-2016 – IV R 34/13), dass die Vermietung eines Einkaufszentrums nicht zwangsläufig als Gewerbebetrieb – und somit Gewerbesteuerpflichtig –, anzusehen ist, weil der Vermieter die für ein Einkaufszentrum üblichen Infrastruktureinrichtungen (Parkplatz, Abstellräume, öffentliche Einrichtungen, etc.) bereitstellt oder werbe- und verkaufsfördernde Maßnahmen für das Gesamtobjekt durchführt. Der BFH ist in seinem Urteil der Ansicht, dass diese zusätzlichen Leistungen, die der Vermieter eines Einkaufszentrums typischerweise in der Regel anbietet, einen Teil der üblichen Miettätigkeit bilden.
Laut Art. 2 I 1 GewStG (Deutsches Gewerbesteuergesetz), unterliegt der Gewerbesteuer jeder stehende Gewerbebetrieb, soweit er im Inland betrieben wird. Nach der vom BFH abgewickelter Rechtsprechung ist die private Vermögensverwaltung kein Gewerbebetrieb. Grundsätzlich ist Vermietung von unbeweglichem Vermögen private Vermögensverwaltung und kein Gewerbebetrieb.
Die Grenze zwischen Vermögensverwaltung und Gewerbebetrieb wird überschritten, wenn der Vermieter umfassende zusätzliche Leistungen anbietet, die dafür sorgen, dass die eigentliche Vermietung des Objekts in den Hintergrund tritt.
Das Urteil des BFH ist vorteilhaft für die Vermieter von Einkaufszentren, welche jetzt, durch die Tatsache, dass sie verkaufsfördernde Leistungen des Zentrums anzubieten oder in diesen Fällen übliche Infrastrukturmaßnahmen zur Verfügung stellen nicht Gefahr laufen zu sehen, dass ihre Vermögensverwaltungstätigkeit (gewerbesteuerfrei), neu als Gewerbe qualifiziert werden kann und infolgedessen Gewerbesteuerpflichtig ist.

[value] => El Tribunal Fiscal Federal (BFH) ha decidido (14-07-2016 – IV R 34/13) que el arrendamiento de un centro comercial no tiene que ser necesariamente considerado como una actividad económica, sujeta al Impuesto de Actividades Económicas, por el hecho de que el arrendador ponga a disposición las infraestructuras habituales (aparcamiento, almacenes, servicios públicos, etc.) u ofrezca prestaciones adicionales tales como servicios de promoción comercial del centro. El BFH considera en su sentencia que las prestaciones adicionales que habitualmente ofrece el arrendador de un centro comercial forman parte de la actividad de arrendamiento.
Según el art. 2 I 1 GewStG (Ley alemana del Impuesto de Actividades Económicas), toda actividad económica (comercial o industrial) realizada en Alemania están sujetos al Impuesto de Actividades Económicas. Según la jurisprudencia desarrollada por del BFH, la administración de patrimonio privado no es una actividad económica en este sentido, por lo que queda exenta de este impuesto. De manera general, el arrendamiento de un inmueble se considera una actividad propia de administración de patrimonio.
Sin embargo, se traspasa la línea divisoria entre administración de patrimonio y actividad económica cuando el arrendador ofrece ampliamente prestaciones adicionales que hacen que el propio arrendamiento pase a un segundo plano.
La sentencia del BFH es favorable a los arrendadores de centros comerciales, los cuales ahora, por el hecho de ofrecer servicios de promoción comercial del centro o puesta a disposición las instalaciones habituales en estos casos, no corren el peligro de ver que su actividad de administración patrimonial (exenta del Impuesto de Actividades Económicas) pueda ser recalificada como actividad económica, y, por lo tanto, sujeta al Impuesto de Actividades Económicas.
