[value] => Das Gericht der Europäischen Union hat am vergangenen 5. April die Berufung seitens RENFE, das spanische Eisenbahn-Verkehrsunternehmen, gegen die Entscheidung des Amtes der Europäischen Union für Geistiges Eigentum (EUIPO) bezüglich der Nichtigkeit der Gemeinschaftsmarke AVE (eine Abkürzung für das spanische Hochgeschwindigkeitsnetz) für Landfahrzeuge und –geräte (Züge, Fahrräder, Wagen, usw.) abgewiesen. Diese Nichtigkeitsentscheidung wurde am 4. Februar 2014 im Rahmen eines von dem deutschen Hersteller von Elektro-Fahrrädern, Herrn Stephan Hahn, und Inhaber der deutschen Handelsmarke “ave” für Landfahrzeuge und –geräte, eingeleiteten Verfahrens erlassen. Das EUIPO ist dabei davon ausgegangen, dass eine Verwechslungsgefahr zwischen beiden Marken besteht und daher wurde dem Antrag auf Teilnichtigkeit, bezogen auf die oben genannte Kategorie, stattgegeben. In dieser Nachricht ist insbesondere ein – perfekt vermeidbares – formelles Detail wichtig, zumal RENFE’s Beschwerde gegen die Entscheidung des EUIPO abgewiesen wurde, da diese nur in spanischer Sprache eingereicht worden war, und RENFE abgelehnt hatte, die Beschwerde übersetzt auf Englisch einzureichen, obwohl es eine Frist von 1 Monat hierfür erhalten hatte. So wies das Gericht der Europäischen Union die Argumente von RENFE ab, da es in Verletzung der einschlägigen Vorschriften, welche besagen, dass Englisch als Sprache des Verfahrens gilt, eingereicht wurde.
Allerdings hat die spanische Einrichtung darauf hingewiesen, dass die Teilnichtigkeit, die nun rechtskräftig ist, nicht verhindern wird, dass RENFE weiterhin ihre Marke AVE im Verkehr benutzt, da diese Marke in der Kategorie der Personenbeförderung eingetragen ist. Daher bleibt abzuwarten, ob nach dieser Teilnichtigkeit Herr Hahn versuchen wird, RENFE die Nutzung der Handelsmarke im Verkehr zu verbieten.

[value] => El pasado 5 de abril, el Tribunal General de la Unión Europea desestimó el recurso presentado por RENFE ante la resolución de la Oficina de la Unión Europea de Propiedad Intelectual (EUIPO) que declaraba la nulidad de su marca comunitaria AVE en relación con toda clase de vehículos y aparatos de locomoción terrestre (trenes, bicicletas, coches, etc.). Dicha resolución de nulidad se había dictado el 4 de febrero de 2014 en el marco de un procedimiento de nulidad iniciado a instancias de un fabricante alemán de bicicletas eléctricas, el Sr. Stephan Hahn, titular de la marca alemana “ave” para vehículos y apartados de locomoción terrestre. La EUIPO entendió que había riesgo de confusión entre ambas marcas y por lo tanto estimó una nulidad parcial del registro de RENFE, centrada en la categoría mencionada anteriormente. En esta noticia cobra especial importancia un detalle formal, perfectamente evitable, referido a que el recurso presentado por RENFE contra la decisión de la EUIPO fue desestimado por estar presentado únicamente en español, negándose RENFE a presentar su escrito en inglés, aún habiendo recibido un plazo de subsanación de 1 mes para ello, por lo que el Tribunal General de la Unión Europea desestimó los argumentos de RENFE al no haber presentado su escrito de acuerdo con la normativa correspondiente y que establece el inglés como lengua del procedimiento.
No obstante, la entidad española ha indicado que la resolución de nulidad parcial, que ahora es firme, no le va a impedir continuar utilizando su marca AVE en el tráfico, ya que RENFE mantiene el registro de la marca AVE para la categoría de transporte de viajeros. Queda por lo tanto por ver si, una vez conseguida la nulidad parcial de la marca comunitaria ante la EUIPO, el Sr. Hahn intentará impedirle a RENFE el uso de la marca AVE en el tráfico.
