[value] => Immer wieder überraschend für ausländische Gläubiger spanischer Unternehmen ist, dass in den Insolvenzverfahren nach deren Eröffnung sehr kurze Fristen laufen, um die Forderung anzumelden. Grundsätzlich gilt, dass die Forderungen binnen Monatsfrist nach Bekannmachung des Eröffnungsbeschlusses im Staatsanzeiger – BOE, Boletin Oficial de Estado bzw. in dessen Pendants der Gebietskörperschaften beim Insolvenz-verwalter angemeldet werden muss. Diese informieren leider nicht immer fristgerecht ausländische Gläubiger bei Konkursfällen.
Es empfiehlt sich daher bei Forderungsausfällen spanischer Kunden, bei denen sich eine Insolvenz abzeichnet, regelmäßig im Internet nach Bekanntmachungen zu recherchieren. Dies kann relativ einfach geschehen, indem etwa bei „google.es“ die Begriffe: „BOE“, „concurso“ plus „Firmenname“ eingegeben werden. Im Falle eines Eröffungsbeschlusses erscheint ein Ergebnis dann in den oberen Zeilen. Wie in Deutschland auch, können Konkursforderungen auch per Email bei den Insolvenzverwaltern angemeldet werden. In der Regel verlangen die spanischen Verwalter jedoch mehr Belege als ihre deutschen Kollegen, insbesondere Auszüge aus der Buchhaltung und auch Kopien der Verträge/Bestellungen werden oftmals angefordert. Bei höheren Forderungen empfiehlt sich sicher die Mandatierung eines Vertreters in Spanien, der dann auch bei Vergleichsverhandlungen die eigenen Interessen vertreten kann.

Esta guía nos parece un buen vademecum a disposición de los empresarios, donde se se describen los distintos panoramas relacionados con problemas económicos, de financiación o de líquidez. Las complejas regulaciones de la Ley Concursal y sus últimas modificaciones, pensadas para salvar empresas que se encuentran en situaciones de insolvencia, se explican de forma comprensible y con muchos ejemplos ilustrativos.
Una lectura más que recomendable, incluso en épocas de bonanza, ya que entonces la información será acogida con menos angustia.
