Übergangsbestimmung des Körperschaftsteuergesetzes regelt, dass die Wertaufholung von aufgrund der Wertminderung von Anteilen erlittenen Verlusten, die in vor dem 01.1.2013 begonnenen Veranlagungszeiträumen als steuerlich absetzbar galten, mindestens zu gleichen Teilen in der Bemessungsgrundlage jeder einzelnen der ersten 5 Veranlagungszeiträume ab dem 01.01.2016 berücksichtigt werden muss.
In ihrer verbindlichen Rechtsauskunft CV0155/2017 vom 24. Januar präzisiert nun die Generaldirektion für Abgaben, dass die Wertaufholung einer Wertminderung, nach Absatz 3 der 16. Übergangsbestimmung, am letzten Tag des Veranlagungszeitraums erfolgt.
Hierbei handelt es sich um ein relevantes Beurteilungskriterium, nicht nur im Zusammenhang mit denjenigen Übertragungen, die von in vergangenen Veranlagungszeiträumen wertgeminderten Anteilen während des Veranlagungszeitraums vorgenommen werden, was dem in vorgenannter Rechtsauskunft geprüftem Sachverhalt entspricht, sondern auch bei der Festsetzung der während desselben zu leistenden Steuervorauszahlungen.

[value] => El apartado 3 de la disposición transitoria 16ª de la Ley del Impuesto sobre Sociedades establece que la reversión de las pérdidas por deterioro de participaciones que hayan resultado fiscalmente deducibles en periodos impositivos iniciados con anterioridad al 01.01.2013 se deben integrar como mínimo por partes iguales en la base imponible de cada uno de los 5 primeros periodos impositivos que se inicien a partir del 01.01.2016.
La Dirección General de Tributos en su consulta CV0155/2017 de 24 de Enero establece el criterio que la reversión del deterioro previsto en el apartado 3 de la disposición transitoria 16ª se produce el último día del periodo impositivo.
Este criterio tiene trascendencia, no solo en relación con las transmisiones de participaciones deterioradas en periodos impositivos anteriores, que se realicen durante el periodo impositivo, hecho analizado en la consulta citada, sino también en la determinación de los pagos fraccionados a realizar durante el mismo.
