[value] => Die zeitlich begrenzte höhere Aktivität oder Geschäftstätigkeit in einem Unternehmen führt oft zu einer unerlässlichen Einstellung von Arbeitnehmern, die unter anderem von Zeitarbeitsfirmen vermittelt werden. Die strikten Bestimmungen zu Zeitarbeitsfirmen („ETT“, „empresas de trabajo temporal“) werden im Gesetz 14/1994 vom 1. Juni geregelt. Das ebenfalls einschlägige Gesetz 15/1999 vom 29. November (im Folgenden „LETT“ genannt) handelt von der Überlassung von Arbeitnehmern im Rahmen grenzüberschreitender Dienstleistungen.
Gesetzliche Ansprüche an einen Überlassungsvertrag
Die Fälle, in denen man sich an Zeitarbeitsfirmen zur Einstellung eines Arbeitnehmers wenden kann, sind beschränkt. Folgende gesetzliche Ansprüche gelten für den Überlassungsvertrag befristeter Arbeitnehmer:
- Der Überlassungsvertrag muss gemäß Artikel 6.3 LETT schriftlich erfolgen.
- Gewisse Klauseln sind verboten im Vertrag, wie die Einstellung des Arbeitnehmers durch das ausleihende Unternehmen am Ende des Überlassungsvertrages (Art. 7.3 LETT).
- Des Weiteren ist es verboten Arbeitnehmer wegen eines Streiks auszuleihen, wenn das ausleihende Unternehmen in den letzten 12 Monaten ein Arbeitsverhältnis ungerechtfertigt bzw. gemäß Artikel 50, 51, 52 des Arbeitnehmerstatus gekündigt hat oder, wenn es sich um die Abgabe von Arbeitnehmern an ein anderes Unternehmen handelt.
Das Einstellen von Arbeitnehmern einer Zeitarbeitsfirma bietet Vorteile hinsichtlich der Sozialversicherungsbeiträge, da diese – wenn auch mit Ausnahmen – von der Zeitarbeitsfirma übernommen werden.
Arbeitsbedingungen und Gehalt
Es gelten die gleichen Normen für Arbeitnehmer von Zeitarbeitsfirmen wie für direkt Angestellte des ausleihenden Unternehmens in Spanien. Die Vergütung der besetzten Stelle orientiert sich nach geltendem Recht und dem einschlägigen Tarifvertrag. Dadurch soll der Mindestlohn nicht umgangen werden können.
En una empresa, un aumento repentino de trabajo puede hacer necesaria la contratación de más personal. Los trabajadores pueden proceder de agencias de empleo, de solicitudes espontáneas, o de empresas de trabajo temporal (ETT). Estas últimas son empresas, reguladas en la Ley 14/1994 del 1 de junio, que, mediante un contrato de puesta a disposición con la empresa usuaria, ponen a su disposición trabajadores por un tiempo determinado. Adicionalmente, la Ley 15/199 de 29 de noviembre regula el desplazamiento de trabajadores en el marco de una prestación de servicios transfronterizos.
De esta manera, las empresas pueden recurrir a la contratación de trabajadores procedentes de empresas de trabajo temporal extranjeras, no sólo por la rapidez de la puesta a disposición de los mismos, sino también en base a la especialización y a las ventajas económicas que ofrece esta alternativa (el empresario, por ejemplo, no debe pagar las cotizaciones a la Seguridad Social).
No obstante lo anterior, los casos que ofrecen la posibilidad de este tipo de contratación son limitados y se requieren determinadas exigencias formales para el contrato de puesta a disposición. Algunas de ellas son:
- Este tipo de contratación queda limitado a los casos previstos para trabajadores de duración determinada (art. 6.2 LETT)
- El contrato debe constar por escrito (art. 6.3 LETT)
- Está prohibida la contratación del trabajador por parte de la empresa usuaria tras la finalización del contrato de puesta a disposición (art 7.3 LETT)
- Está prohibido recurrir a trabajadores procedentes de ETT en caso de huelga, o cuando la empresa hubiera suprimido puestos de trabajo injustificadamente en los 12 meses anteriores
Cabe señalar que los trabajadores procedentes de ETT están sometidos a las mismas normas que los trabajadores contratados directamente en España (salario mínimo, normativa aplicable, etc.).
