[value] => Mit Urteil vom 23.03.2017 hat das Bundesarbeitsgericht (BAG) die arbeitsvertragliche Regelung einer verkürzten Kündigungsfrist in der Probezeit strengen Anforderungen unterworfen.
Ist im Arbeitsvertrag eine Probezeit von maximal sechs Monaten vereinbart, so kann nach deutschem Recht jede Vertragspartei das Arbeitsverhältnis unter Wahrung einer zweiwöchigen Frist kündigen, ohne dass hierzu eine weitere arbeitsvertragliche Bestimmung erforderlich wäre.
Sieht jedoch ein vom Arbeitgeber vorformulierter Arbeitsvertrag eine über diese zweiwöchige Frist hinausgehende allgemeine Kündigungsfrist vor, wird eine erhöhte Schutzbedürftigkeit des Arbeitnehmers angenommen. Der Arbeitnehmer darf demnach davon ausgehen, dass diese Kündigungsfrist auch im Rahmen der Probezeit gilt, es sei denn, Gegenteiliges ist eindeutig und unmissverständlich im Vertrag geregelt.
Im entschiedenen Fall enthielt § 1 eines vom Arbeitgeber vorformulierten Arbeitsvertrages einen pauschalen Verweis auf einen Manteltarifvertrag, der im Rahmen der Probezeit spezielle Kündigungsfristen festlegte. § 8 des Arbeitsvertrages bestimmte jedoch allgemein eine Kündigungsfrist von sechs Wochen zum Monatsende.
Nach Entscheidung des BAG greift die in § 8 des Arbeitsvertrages vereinbarte Kündigungsfrist auch während der Probezeit, da der Arbeitnehmer allein durch den generellen Verweis auf den Manteltarifvertrag die Geltung einer von § 8 abweichenden Kündigungsfrist nicht erkennen konnte. Laut BAG stellen vom Arbeitgeber vorformulierte Klauseln eines Arbeitsvertrags Allgemeine Geschäftsbedingungen dar, deren Auslegung grundsätzlich aus der Perspektive eines durchschnittlichen, in der Regel juristisch nicht versierten Arbeitnehmers erfolgen muss.
Soll also eine die Kündigungsfrist regelnde Klausel für die Probezeit nicht gelten, so muss diese Ausnahme eindeutig und ausdrücklich in den Arbeitsvertrag aufgenommen werden.

[value] => Con sentencia del 23.03.2017, el Tribunal Federal Alemán de Trabajo (BAG) ha impuesto condiciones restrictivas al acuerdo en un contrato laboral sobre un plazo de preaviso de rescisión de contrato en el periodo de prueba inferior al plazo de preaviso general (una vez superado el periodo de prueba).
Según el derecho alemán, si el contrato laboral prevé un periodo de prueba de hasta seis meses, cada parte puede extinguir la relación laboral con un preaviso de dos semanas, a falta de un acuerdo contrario.
Si se pacta un plazo de preaviso general superior a estas dos semanas en un contrato laboral pre-formulado, se presume la necesidad de una protección especial del empleado. Éste puede entender, de no haber otro acuerdo formulado clara y de manera expresa en el contrato, que este plazo de extinción más largo también se aplica al periodo de prueba.
En el caso del litigio, el artículo 1 de un contrato laboral pre-formulado por el empleador contenía una referencia general a un convenio colectivo marco que regulaba el plazo de preaviso en el periodo de prueba, sin concretizar éste expresamente en el contrato. El artículo 8 del mismo contrato fijaba un plazo de preaviso general de seis semanas a finales de un mes.
Según el fallo del BAG, el plazo de preaviso general acordado en el artículo 8 del contrato se aplica igualmente al plazo en el periodo de prueba. Sólo con la referencia al convenio colectivo no le era posible al empleado tener conocimiento sobre un plazo de preaviso aplicable al periodo de prueba distinto al plazo general que preveía el contrato. De acuerdo con la jurisprudencia del BAG, son condiciones generales de contrato las clausulas pre-formuladas por el empresario en un contrato de trabajo, que se tienen que interpretar desde la perspectiva de un empleado con una formación mediana y sin conocimientos jurídicos.
Si, por tanto, una cláusula que regula un plazo de preaviso para la extinción del contrato no se debe aplicar al plazo de preaviso en el periodo de prueba, es necesario hacerlo constar expresamente en el contrato laboral.
