[value] => Der Bundestag hat am 10. März das Gesetz zur Reform des Bauvertragsrechts verabschiedet. Viel spricht dafür, dass der Bundesrat dem Gesetz in unveränderter Form zustimmen wird. Das Gesetz soll für alle ab dem 1. Januar 2018 geschlossenen Verträge gelten und enthält Bestimmungen zum Bauvertrag, Architekten- und Ingenieurvertrag sowie zum Bauträgervertrag.
Bisher war das Bauvertragsrecht im Bürgerlichen Gesetzbuch (BGB) nur am Rande behandelt. Die Grundlagen des Privaten Baurechts mussten daher vornehmlich durch die Rechtsprechung und die juristische Literatur entwickelt werden.
Mit dem neuen Gesetz werden u.a. spezielle Regelungen für den Bauvertrag und den neu geschaffenen sogenannten Verbraucherbauvertrag in das Werkvertragsrecht des Bürgerlichen Gesetzbuchs (BGB) eingefügt.
Mit dem in §§ 650i bis 650n BGB geregelten Verbraucherbauvertrag wird ein neuer Vertragstypus geschaffen. Verbraucherbauverträge sind Verträge, durch die der Unternehmer von einem Verbraucher zum Bau eines neuen Gebäudes oder zu erheblichen Umbaumaßnahmen an einem bestehenden Gebäude verpflichtet wird. Der Verbraucher muss vor Vertragsschluss und während der Ausführung umfassend informiert werden. Der Inhalt der vertragsgegenständlichen Baubeschreibung wird gesetzlich vorgegeben, wobei im Zweifel die für den Verbraucher günstigere Auslegung Vorrang hat. § 650l räumt dem Verbraucher ein Widerrufsrecht ein, es sei denn, der Vertrag wurde notariell beurkundet. Der Unternehmer ist verpflichtet, den Verbraucher über sein Widerrufsrecht zu belehren. Der Verbraucherbauvertrag bedarf der Textform, die einheitlich für alle den Verbraucherbauvertrag betreffenden Regelungen gilt.

[value] => El Parlamento Federal alemán (Bundestag) ha aprobado el 10 de marzo la Ley de reforma del contrato de obra. Todo apunta a que el Senado (Bundesrat) va a dar su visto bueno sin enmiendas. Esta ley se aplicará a todos los contratos celebrados a partir del 1 de enero de 2018 y contiene disposiciones relativas al contrato de obra, al contrato con arquitectos e ingenieros y al contrato con promotores.
Hasta ahora, el contrato de construcción solamente se trataba de manera parcial en el BGB (Código Civil alemán). Por eso, las bases del Derecho de la Construcción fueron desarrolladas principalmente por la jurisprudencia y la doctrina.
Con la nueva ley, se introducen en el apartado dedicado en el BGB al contrato de obra nuevas reglas especiales para, entre otros, el contrato de construcción y para el nuevo tipo contractual del contrato de construcción con consumidores.
Con las nuevas normas sobre el contrato de construcción con consumidores regulado los arts. 650i a 650n BGB se crea un tipo contractual nuevo. Los contratos de construcción con consumidores son contratos mediante los cuales un empresario se compromete frente a un consumidor a la construcción de un edificio nuevo o a una remodelación relevante de un edificio existente. Antes de la celebración del contrato y durante su ejecución, el consumidor tiene que recibir una información completa. La ley establece el contenido obligatorio de la descripción de la construcción objeto del contrato, debiendo interpretarse a favor del consumidor en caso de duda. El art. 650l concede al consumidor un derecho de desistimiento del contrato, a no ser que el contrato se haya escriturado ante notario. El empresario está obligado a informar al consumidor sobre su derecho de desistimiento. El contrato de construcción con consumidores tiene que celebrarse en forma textual, debiendo incluirse en esta forma todos los acuerdos adoptados.
