[value] => In Deutschland gilt die sogenannte Störerhaftung, d.h. dass derjenige, der einen Internetzugang bereitstellt und damit eine Gefahrenquelle für Rechtsverletzungen eröffnet, unter bestimmten Umständen haften kann. Die Rechteinhaber können daher bei Verstößen von den Anbietern des WLAN-Zugangs verlangen, dass sie angemessenen Schutz gegen Rechtsverletzungen etablieren. Dafür eignet sich nach der Rechtsprechung des EuGH vor allem eine Zugangsbeschränkung durch die Vergabe von Nutzerpasswörtern. Bei nicht gesicherten Zugängen laufen WLAN-Betreiber derzeit Gefahr, kostenpflichtig wegen des fehlenden Schutzes abgemahnt zu werden.
Das Bundeswirtschaftsministerium versucht mit dem „Entwurf eines dritten Gesetzes zur Änderung des Telemediengesetzes“ diese Haftung einzuschränken. Nach dem Entwurf sollen Passwörter und Nutzerregistrierungen ausdrücklich nicht als Schutzmaßnahmen in Betracht kommen. Diese seien – entgegen der Wertung des EuGH – den Betreibern nicht zumutbar. Die einzige Schutzmaßnahme, die der Entwurf stattdessen benennt, ist die Sperre rechtsverletzender Inhalte. Aber die von der deutschen und europäischen Rechtsprechung in jüngerer Zeit für zulässig erachteten Netzsperren – also das Sperren einzelner Webseiten oder von Ports, über die Filesharing-Programme laufen – werden in vielen Fällen nicht helfen können. Denn sofern rechtswidrige Inhalte nicht überwiegen, käme eine Sperrung einzelner Seiten nicht in Betracht, da das Grundrecht der Internetnutzer auf Informationsfreiheit dem entgegenstünde, wie BGH und EuGH bereits entschieden haben. Sollte für diesen Fall keine wirksame Schutzmaßnahme zur Verfügung stehen, die den Passwortschutz ersetzt, läuft die neue Regelung Gefahr, gegen das Europarecht zu verstoßen –und schlimmstenfalls vom EuGH für unanwendbar erklärt zu werden.

[value] => En Alemania existe la llamada “Störerhaftung” (responsabilidad del titular de un acceso a internet). Es decir, si se cumplen algunos requisitos, aquella persona que ponga a disposición de otros un acceso a internet y, con esto, abra una vía de riesgo para que se produzcan vulneraciones de derechos, será considerado responsable. Con esto, los titulares de los derechos vulnerados, pueden dirigirse contra el titular de un acceso wifi para exigirle que tome las medidas de protección adecuadas para evitar las vulneraciones. Según la jurisprudencia del TJUE, una medida de protección adecuada es el bloqueo del acceso mediante una contraseña. En caso de que el acceso a internet no cuente con medidas de protección, el administrador del wifi corre el peligro de ser amonestado y de tener que pagar los costes derivados.
El Ministerio Federal de Economía alemán intenta limitar esta responsabilidad mediante una reforma (Entwurf eines dritten Gesetzes zur Änderung des Telemediengesetzes). Este proyecto no incluye como medidas de protección ni las contraseñas ni el registro de usuarios, ya que se considera, en contra de lo que dice el TJUE, que eso no se puede exigir a los titulares del acceso wifi. La única medida de protección que menciona el proyecto es el bloqueo de contenidos ilegales. Pero los bloqueos admitidos por la jurisprudencia europea y la alemana, es decir, el bloqueo de algunas páginas web o de puertos con programas de “filesharing”, no van a ser de gran ayuda en muchos casos, ya que mientras que su contenido no sea mayoritariamente ilegal, no se pueden bloquear páginas web concretas. Esto vulneraría el derecho fundamental de libertad de información de los usuarios de internet, tal y como ya han decidido el BGH (Tribunal Federal Superior alemán) y el TJUE. Si no se encuentra ninguna medida de protección alternativa a las contraseñas, la nueva regulación corre el peligro de vulnerar el derecho europeo y, en el peor de los casos, de que sea declarada nula por el TJUE.
