[value] => Der EuGH hat Evonik (ehemals Degussa) im Kampf gegen die Veröffentlichung von Kronzeugeninformationen zum Bleichmittelkartell Recht gegeben.
Auf Grund der Kronzeugenregelung können einem Unternehmen, das Preisabsprachen anzeigt, Geldbußen erlassen oder diese reduziert werden. Das Bundeskartellamt wirbt auf seinen Internetseiten für das anonyme Anzeigeverfahren (sog. „Bonusregelung“).
Das Unternehmen Evonik war als solch ein Kronzeuge in einem Verfahren um ein Bleichmittelkartell aufgetreten, mit dem Ergebnis des Erlasses einer Geldbuße. Die EU-Kommission hatte im Jahre 2007 eine gekürzte Version der Bußgeldentscheidung veröffentlicht. Im Jahr 2011 teilte sie mit, eine ausführlichere Entscheidung veröffentlichen zu wollen. Hiergegen legte Evonik wegen der möglichen Veröffentlichung von Kronzeugeninformationen Klage beim EG ein und stellte Antrag auf Erlass einer einstweiligen Anordnung gegen die Veröffentlichung. Im Hauptsacheverfahren wies das EG die Klage jedoch ab, weshalb Evonik in die nächsthöhere und letzte Instanz – zum EuGH – zog.
Der EuGH hat nach dem vorläufigen Erlass einer einstweiligen Anordnung mit Urteil vom 14.03.2017 (Rs. C-162/15 P) in der Hauptsache zu Gunsten von Evonik entschieden und der Veröffentlichung einer ausführlichen Bußgeldentscheidung durch die EU-Kommission widersprochen. Dabei hat er selbst aber nicht grundsätzlich über den Vertrauensschutz von Kronzeugen entschieden, und auch nicht gänzlich die Möglichkeit ausgeschlossen, bestimmte, aus Kronzeugenprogrammen erhaltene Daten zu veröffentlichen, sondern festgestellt, dass eine Prüfung, ob die Veröffentlichung gegen die Grundsätze des Vertrauensschutzes verstoße, im Vorverfahren durch den Anhörungsbeauftragten offensichtlich nicht erfolgt sei.
Unterstützt man die – umstrittene – Kronzeugenregelung, so sollte dem Vertrauensschutz des Kronzeugen bei der Interessenabwägung Öffentlichkeit – Vertrauensschutz besondere Bedeutung zukommen, da eine fehlende Vertraulichkeit der mitgeteilten Informationen andernfalls sicherlich das Anzeigeverhalten anderer Beteiligter negativ beeinflussen würde.

[value] => El TJUE ha respaldado a Evonik (anteriormente: Degussa) en su lucha contra la publicación de información resultante de un programa de clemencia.
El programa de clemencia permite a las empresas que forman parte de un cártel y pongan en conocimiento de la Autoridad de Competencia su existencia, la exención del pago de la multa que pudiera corresponderle o una reducción del importe de ésta. La Oficina Federal de la Competencia Alemana promociona en su página web este programa de clemencia.
La empresa Evonik se ha favorecido de un programa de clemencia en relación con un cártel de empresas de decolorantes, y le ha sido perdonada la multa. La Comisión Europea había publicado una versión corta de la decisión en el año 2007, y ha anunciado en el año 2011 la publicación de una versión más exhaustiva. Evonik ha interpuesto demanda contra esta decisión ante el Juzgado de Primera Instancia de la UE, solicitando a la vez medidas cautelares. Al haber sido desestimada la demanda, Evonik ha interpuesto recurso ante la instancia superior e última, el TJUE.
El TJUE, con sentencia del 14.03.2017 (C-162/15P), ha fallado a favor de Evonik, pues, ha rechazado la publicación de un informe exhaustivo. Sin embargo, el TJUE no ha decidido finalmente sobre una posible infracción de los principios de protección de la confianza legítima y de seguridad jurídica, y no ha rechazado la posibilidad general de publicar cierta información obtenida tras estos programas. Más bien, ha hecho constar que en el trato confidencial de los datos relevados de solicitantes de clemencia, en este caso, no ha sido tenido suficientemente en consideración en el procedimiento administrativo anterior por el consejero auditor, que se abstuvo indebidamente de pronunciarse en esta relación.
Es necesaria una ponderación ajustada entre el interés público y el interés de la protección y confidencialidad. Por lo menos de ser partidario del programa – controvertido - de clemencia, se debería hacer hincapié en la protección de la confidencialidad. De lo contrario es probable que el interés en participar en el programa disminuya.
