[value] => Im Rahmen eines Antrags auf Erlass eines europäischen Mahnbescheides vor einem spanischen Gericht wurde der Antragsteller aufgefordert, die Gerichtsgebühr binnen fünf Werktagen einzuzahlen, anderenfalls das Verfahren eingestellt würde. Die Gerichtsgebühren gingen nach der Fünftagesfrist ein, das Verfahren wurde archiviert mit dem Hinweis, es könne ein neuer Antrag gestellt werden. Dies geschah, unter pünktlicher Zahlung der Gebühren diesmal. Im Anschluss beantragte der Gläubiger beim spanischen Finanzamt – in Spanien werden die Gerichtsgebühren beim Finanzamt eingezahlt, nicht bei dem zuständigen Gericht - die Erstattung der erstmalig eingezahlten Gebühr mittels einer sog. solicitud de ingresos indebidos – Antrag auf Erstattung einer grundlosen Einzahlung. Zur Überraschung des Antragstellers wurde die Erstattung verweigert mit der Begründung, der erste Mahnbescheid sei mit einem Formfehler behaftet gewesen, aufgrund dessen die Einstellung erfolgt sei – damit bestünde kein Anspruch auf Erstattung.
Im Einspruchsverfahren wurde vorgetragen, das Verfahren sei nicht etwa wegen eines Formfehlers (falsches Gericht/ falscher Antragsgegner/falsches Formular) eingestellt worden, sondern weil keine Zahlung erfolgt sei, somit könne die nachträglich erfolgte Zahlung nicht mehr Bestandteil des Mahnantrags sein. Aber auch die höhere Verwaltungsbehörde gab dem Erstattungsantrag nicht statt. Und jetzt überraschend auch das spanische Verwaltungsgericht in Madrid mit der Begründung, die Gebühr für den Antrag des Erlasses des Mahnbescheides sei mit dessen Antragstellung fällig geworden; der Zeitpunkt der Zahlung sei für das (Fort)Bestehen der Schuld, die Gebühr zu entrichten, somit unerheblich, ergo auch die verspätete Zahlung der Gebühr des Verfahrens sei noch dessen Bestandteil, sei also nicht rechtsgrundlos ergangen. In der Konsequenz bedeutet dieses Argument doch, dass im Falle einer Nichtzahlung das Gericht - das Finanzamt - die Zahlung der Gebühr einfordern könnte auch nach Einstellung des Verfahrens? [value] => En el marco de un procedimiento monitorio europeo ante un juzgado español, el demandante fue requerido por éste de ingresar la tasa judicial en el plazo de cinco días, al no ser así se archivaría el expediente. El ingreso se hizo pero llegó fuera de plazo. El procedimiento se archivó, indicando el juzgado que se puede presentar una nueva solicitud para iniciar el procedimiento monitorio. Así se hizo, pagando la tasa nuevamente, esta vez dentro del plazo marcado. A continuación se solicitó ante la agencia tributaria la devolución de la primera tasa por ingresos indebidos. Solicitud que fue denegada tanto por la AEAT como en la reclamación ante el TEAR con el argumento que el ingreso de la tasa (fuera de plazo) forma parte del procedimiento y por lo tanto no procede la devolución en caso de archivo. El juzgado de administración ha confirmado este criterio. Como el pago de la tasa se debería haber hecho a la vez que la solicitud, no es lícita la devolución en caso de archivo por falta de ingreso.
Pregunta: dejando al margen el tema que los modos de pago previstos por la UE para el procedimiento monitorio europeo siguen siendo ignorados en España y dejando al margen que los plazos concedidos en el procedimiento monitorio europeo son más que cortos, ¿el argumento del juzgado es válido? En consecuencia, los juzgados podrían exigir el pago de las tasas judiciales ex post en los casos que se archive un procedimiento por falta de ingreso.
