[value] => Das größte noch ausstehende Schiedsurteil, bei dem eine riesige Gruppe von Photovoltaik-Investoren 1,3 Milliarden EUR forderte, welche sich zuzüglich Kosten und Zinsen auf fast 2 Milliarden EUR beliefen, ist praktisch ins Leere gelaufen. Nach fast neun Jahren Streit haben die Schiedsrichter von Uncitral, dem UNO-Sitz an dem der Streit entschieden wurde, die Entschädigung für die Kürzungen bei den erneuerbaren Energien nach Angaben von Quellen, die mit dem Verfahren vertraut sind, auf rund 90 Millionen Euro und ohne Kosten festgesetzt. Dies war die größte Bedrohung für den spanischen Staat bei den Schiedssprüchen.
Im Jahr 2011 taten sich Dutzende internationaler Investoren, die in Spanien in die Photovoltaik investiert hatten, zusammen und erhoben das erste internationale Schiedsverfahren gegen die Kürzung der Prämien für erneuerbare Energien. Sie beriefen sich auf das Energieabkommen und erhoben Klage aufgrund der Tatsache, dass die ersten krisenbedingten Prämiensenkungen gegen diesen Vertrag verstießen. Sie wandten sich an Uncitral, einem der Orte, an dem diese Streitigkeiten beigelegt werden.
Der Fall zog sich in die Länge, weil verschiedene Kürzungen vorgenommen wurden und die Investoren ihre Ansprüche ausweiteten. Obwohl der anfängliche Betrag 1,3 Milliarden EUR betrug, mit Kosten und Zinsen, lag die Prognose der Regierung bei etwa 2 Milliarden EUR. Quellen des Sektors zufolge könnte es für Spanien kaum zufriedenstellender sein. Der Schiedsspruch reduziert den potenziellen Anspruch von 2 Milliarden auf eine geschätzte Gesamtsumme von nur 90 Millionen EUR. Es gibt Investoren, die Hunderte von Millionen verlangten und die weniger erhalten, als sie für Anwälte ausgegeben haben. Der Schiedsspruch hat keine Kostenübernahme geurteilt, so dass jede Partei ihre eigene Verteidigung übernimmt. Allein bei den Kosten belief sich der Anspruch auf 15 Millionen EUR.
Diese Schiedsverfahren werden von drei Schiedsrichtern entschieden: Ein Schiedsrichter wird von den Investoren vorgeschlagen; ein weiterer von Spanien, und das Gericht ernennt den Präsidenten. In diesem Fall hat der von den Investoren vorgeschlagene Schiedsrichter, Charles Bower, eine abweichende Stellungnahme abgegeben.

[value] => El mayor laudo que estaba pendiente de resolución, en el que un grupo enorme de inversores en fotovoltaica reclamaba 1.300 millones, que con las costas e intereses ascendían a casi 2.000 millones, ha quedado prácticamente en nada. Después de casi nueve años de disputa, los árbitros de Uncitral, la sede de la ONU en la que se dirimía, han dejado la indemnización en unos 90 millones de euros por los recortes a las renovables y sin costas, según fuentes conocedoras del procedimiento. Esta era la mayor amenaza al Estado español en los laudos.
En 2011 decenas de inversores internacionales que habían invertido en fotovoltaica en España se agruparon y plantearon el primer arbitraje internacional contra los recortes de primas a las renovables. Se acogían al Tratado de la Energía y denunciaban que los primeros recortes de primas por la crisis incumplían ese tratado. Acudieron a Uncitral, una de las sedes en las que se dirimen estas disputas.
El caso se ha ido alargando porque se fueron añadiendo distintos recortes y los inversores fueron ampliando la reclamación. Aunque la cuantía inicial era de 1.300 millones, con las costas y los intereses, la previsión del Ejecutivo rondaba los 2.000 millones. Según fuentes del sector, difícilmente podría ser más satisfactoria para España. El laudo rebaja los 2.000 millones que podía alcanzar la reclamación de ser estimada en su totalidad a solo 90 millones. Hay inversores que pedían cientos de millones y que recibirán menos de lo que gastaron en abogados. El laudo no hace condena en costas por lo que cada parte asume su defensa. Solo en costas, la reclamación sumaba 15 millones de euros.
Estos arbitrajes se deciden por tres árbitros: uno lo proponen los inversores; otro, España y el tribunal designa al presidente. En este caso, el árbitro propuesto por los inversores, Charles Bower, ha emitido un voto particular discrepante.
