[value] => In letzter Zeit ist viel über die Maßnahmen geschrieben worden, die die spanische Regierung aufgrund vom COVID-19 in den Bereichen Arbeit, Justiz und natürlich auch im Bereich der Steuern ergriffen hat. Die Vorschläge der Regierung beschränken sich jedoch auf die bloße Hemmung bestimmter Fristen für die Zahlung von Steuerschulden und den Zahlungsaufschub für KMU bei Steuerbeträgen bis zu 30.000 Euro auf maximal 6 Monate (wobei ab dem 3. Monat Verzugszinsen zu zahlen sind). Mit anderen Worten: Keine Spur von Steuersenkungen.
Daher ist unabdingbar zu prüfen, welche anderen Maßnahmen zur Senkung der Körperschaftsteuerlast ergriffen werden können. Eine dieser Maßnahmen ist die Verbuchung der Gewinne im Zeitpunkt der tatsächlichen Einziehung und nicht im Zeitpunkt des Verkaufs der Waren oder Dienstleistungen. Dies ist besonders relevant, da viele Marktteilnehmer aufgrund der absehbaren fehlenden Liquidität Zahlungsaufschübe beantragen werden. Dabei ist zu berücksichtigen, dass der Zeitraum zwischen der ersten und der letzten Fälligkeit des Aufschubs mindestens ein Jahr betragen muss. Eine weitere Maßnahme wäre im Detail zu prüfen, welche Zahlungsausfälle aufgetreten sind, um entsprechende Rückstellungen (Ausgaben) zu bilden, die letztlich den Jahresgewinn mindern. Darüber hinaus sollten unter anderem der Verkauf von Vermögenswerten mit Verlust, die Neubewertung des Buchwerts von Vorräten, die Nutzung des Abzugs für Investitionen in Forschung, der Erwerb von Unternehmen mit Verlust und die korrekte Anwendung von Verlustvorträgen, die Rücklage zur Kapitalbildung und Verschmelzungen in Betracht gezogen werden.
Wie wir sehen, gibt es eine ganze Reihe von Maßnahmen, die ein Unternehmen ergreifen kann und sollte, da die Regierung bisher noch keine Schritte unternommen hat, um die Steuerlast der Unternehmen zu verringern.

[value] => Se ha escrito bastante últimamente sobre las medidas tomadas por el Gobierno español a causa del COVID-19 en el ámbito laboral, judicial, y como no, en materia fiscal. Sin embargo, las propuestas del Ejecutivo no van más allá de la mera suspensión de ciertos plazos para el pago de deudas tributarias, y el aplazamiento del pago para PYMES en impuestos de importes inferiores a 30.000 Euros con un periodo máximo de 6 meses (intereses a partir del 3er mes). Es decir, ni rastro de rebaja de impuestos.
Es por ello que se hace indispensable revisar qué medidas se pueden tomar para reducir la carga del Impuesto de Sociedades. Entre estas, y debido a que muchos operadores del mercado solicitarán moratorias en los pagos por la previsible falta de liquidez, se encuentra la de imputar el beneficio no por las ventas efectuadas, sino en el momento en que estas sean efectivamente cobradas. Conviene recordar que el periodo entre el primer y el último vencimiento del aplazamiento debe ser como mínimo de un año. Otra actuación sería examinar en detalle qué impagos se han producido, para dotar las oportunas provisiones (gastos), que a la postre reducen el resultado contable. Además, se debería valorar la venta de activos con pérdidas, la nueva estimación del valor contable de las existencias, la utilización de la deducción por inversiones en investigación, la adquisición de empresas en pérdidas y la correcta aplicación de las bases imponibles negativas, la reserva de capitalización, la ejecución de operaciones de fusión, entre otras alternativas.
Como vemos, existe un buen número de actuaciones que una entidad puede y debe acometer, pues el Gobierno hasta el momento no ha movido ficha para aliviar la carga tributaria de las empresas.
