[value] => Müssen Kautionen, die in Immobilienmietverträgen vereinbart werden, als umsatzsteuerfreie Leistungen betrachtet werden? Und müssen die Einkünfte aus solchen Kautionen in die Pro-Rata-Regelung einbezogen werden, um so das Recht auf Vorsteuerabzug für den Empfänger der Kautionen einzuschränken?
Dies war bisher eine der vielen umstrittenen Fragen im Steuerbereich, da in dieser Angelegenheit wenig bzw. nichts beschlossen wurde.
Vor kurzem hat die Generaldirektion für Steuern ein wenig Licht in diese Angelegenheit gebracht und damit das Kriterium, das sie in den letzten Jahren in dieser Sache verfolgt hat, wesentlich geändert. Die letzten verbindlichen Auskünfte zu diesem Thema, die letzte im Jahr 2010, beinhalteten die Kriterien, die bereits in der verbindlichen Entscheidung vom 24. Februar 1986 festgelegt wurden, die zu folgenden Schlussfolgerungen führten:
"Die in Mietverträgen für Geschäftsräume vereinbarten Kautionen sind nicht mehrwertsteuerpflichtig, wenn sie von einer nicht steuerpflichtigen Person geleistet werden. Mehrwertsteuerpflichtig hingegen sind Kautionen, die von steuerpflichtigen Personen geleistet werden, obwohl sie gemäß Artikel 20 Absatz 1 Nummer 18 Buchstabe f) von der Steuer befreit sind".
In diesem Zusammenhang sei daran erinnert, dass der genannte Artikel vorsieht, dass unter anderem folgende Leistungen von der Steuer befreit sind: "(f) die Gewährung von Garantien, Bürgschaften, Kautionen und anderen dinglichen oder persönlichen Sicherheiten sowie die Ausstellung, Mitteilung, Bestätigung und andere Transaktionen im Zusammenhang mit Dokumentenakkreditiven".
Diese Schlussfolgerung verpflichtete den Empfänger von Kautionen, diese Umsätze in die Pro-Rata-Berechnung aufzunehmen, was das Recht auf Vorsteuerabzug des Steuerzahlers einschränkte und einen erheblichen Nachteil für den Steuerzahler bedeutete, da er somit die Pro-Rata-Regelung auch ohne Bewirkung von anderen steuerfreien Umsätzen in Anspruch nahm.
Die Generaldirektion für Steuern hat jedoch in ihrer jüngsten Auskunft vom 17.9.19 mit der Nummer V2507/19 Folgendes festgelegt, was seitdem zu grundlegenden Änderungen bei den anzuwendenden Kriterien geführt hat: wenn die Kaution die Übergabe eines Geldbetrages durch den Mieter beinhaltet, der am Sitz des Vermieters oder eines Dritten hinterlegt bleibt und der dazu bestimmt ist, einen Betrag vorzuschießen, der notwendig sein könnte, um gegebenenfalls bestimmte Ausgaben am Ende des Mietverhältnisses aufgrund von Schäden, die der Mieter in der Mietsache verursacht hat, zu decken, dann handelt es sich nicht um eine umsatzsteuerfreie Kaution gemäß Art. 20 Erstens, 18 f) des Mehrwertsteuergesetzes, sondern um eine nicht mehrwertsteuerpflichtige Leistung gemäß den Bestimmungen von Artikel 78, Abschnitt Drei, 1 dieses Gesetzes. Dies liegt daran, dass die Kaution kompensatorischen Charakter hat und daher nicht in der Steuerbemessungsgrundlage berücksichtigt werden darf. Das heißt, da sie dazu dient, Schäden auszugleichen, die der Mieter dem Eigentümer möglicherweise zugefügt hat, darf sie nicht als Gegenleistung für einen mehrwertsteuerpflichtigen Vorgang betrachtet werden, und daher dürfen solche Umsätze bei der Berechnung des Pro-Rata-Satzes nicht berücksichtigt werden.

[value] => ¿Deben considerarse las fianzas acordadas en contratos de arrendamiento de inmuebles como operaciones exentas de IVA? ¿Deben computarse los ingresos derivados de dichas fianzas en la regla de prorrata de IVA para determinar la limitación al derecho a deducir el IVA soportado para el perceptor de las mismas?
Ésta ha sido hasta la fecha una de las tantas cuestiones controvertidas en el ámbito tributario puesto que poco o nada se ha concluido sobre esta cuestión.
Recientemente, la Dirección General de Tributos ha vertido algo de luz en cuanto a esta cuestión, modificando sustancialmente el criterio que venía manteniendo sobre dicha cuestión en los últimos años. Las últimas consultas vinculantes emitidas al respecto, la más reciente de 2010, venía a recoger los criterios manifestados ya en la Resolución vinculante de fecha 24 de febrero de 1986, en la que se concluía lo siguiente:
“No están sujetas al IVA las fianzas de los contratos de arrendamiento de locales de negocio si se prestan por quien no tiene la condición de sujeto pasivo. Sin embargo, las prestaciones de fianzas efectuadas por sujetos pasivos del IVA estarán sujetas a dicho impuesto, aunque exentas al mismo, de acuerdo con el artículo 20, número 1, apartado 18, letra f)“.
Cabe recordar a estos efectos que dicho artículo establece que quedan exentas del impuesto, entre otras, “f) la prestación de fianzas, avales, cauciones y demás garantías reales o personales, así como la emisión, aviso, confirmación y demás operaciones relativas a los créditos documentarios”.
Esta conclusión, obligaba al perceptor de las fianzas a incluir dichas operaciones en el cómputo de la prorrata que determinaba la limitación al derecho a deducir IVA del contribuyente, lo que implicaba grandes perjuicios para éste, puesto que le hacía incurrir en la aplicación de la regla de prorrata aún sin efectuar otro tipo de operaciones exentas.
No obstante, la DGT en su reciente consulta de fecha 17/9/19 con número V2507/19 matiza lo siguiente, que deviene fundamental en el cambio de criterio aplicable a partir de dicha consulta: si la fianza supone la entrega de una cantidad de dinero por parte del arrendatario que queda en depósito en sede del arrendador o de un tercero y que tiene por finalidad anticipar un importe que podría ser necesario para hacer frente, llegado el caso, a determinados gastos a la finalización del contrato de arrendamiento como consecuencia de desperfectos que el arrendatario hubiera causado en el inmueble arrendado, entonces no nos encontramos ante una de las fianzas exentas previstas en el art. 20.Uno,18ª f) de la Ley del IVA, sino ante una operación no sujeta al IVA al amparo de lo establecido por el artículo 78, apartado Tres.1º de la citada Ley, por tener dicha fianza un carácter indemnizatorio y, por tanto, no debe tenerse en cuenta en la base imponible del Impuesto. Esto es, al tener por objeto compensar los daños y perjuicios que el arrendatario hubiera podido ocasionar al propietario, no debe considerarse como contraprestación de operación alguna sujeta al IVA y, por tanto, no deben tenerse en cuenta dichas operaciones en el cálculo de la prorrata de IVA.
