[value] => Grenzüberschreitende Darlehensverträge können bei der Bestimmung von Zuständigkeiten Schwierigkeiten bereiten. Das erfuhr auch eine Klägerin in einem Verfahren vor dem Landgericht Bielefeld (Urteil vom 20.07.2016, Az. 3 O 206/15). Die deutsche Klägerin forderte Darlehensrückzahlung von dem Beklagten. Dieser hatte anfangs seinen Wohnsitz in Deutschland, verzog aber später nach Polen. Das Darlehen wurde, auf seine Veranlassung, größtenteils auf ein polnisches Konto ausgezahlt.
Kleiner Unterschied, große Wirkung – das Landgericht Bielefeld hielt deshalb die Klage in Deutschland für unzulässig. Es war der Ansicht, polnische Gerichte seien zuständig. Hintergrund ist eine Regelung in der Brüssel Ia-Verordnung, ein Gesetz, das europaweit einheitlich (u. a.) die internationale Zuständigkeit regelt. Grundsätzlich ist nach der Verordnung ein Beklagter an seinem Wohnsitz zu verklagen. Die Verordnung regelt aber auch einen besonderen Gerichtsstand am Erfüllungsort des Vertrages. Doch wo befindet sich der Erfüllungsort eines Darlehensvertrages? Schon vor der hier besprochenen Entscheidung hatte die Rechtsprechung entschieden, dass das einheitlich für den gesamten Vertrag dort sei, wo die Kredithingabe erfolgt (vgl. BGH, Urteil vom 28.02.2012, Az. XI ZR 9/11). Das Landgericht Bielefeld sah das an dem Ort, wo das Geld dem Konto des Empfängers gutgeschrieben wird, mithin in Polen.
Alternativlos ist diese Einordnung nicht. Besondere Gerichtsstände sollen schließlich die Zuständigkeit eines Gerichts mit besonderer Sachnähe ermöglichen. Wenn der Darlehensnehmer bspw. ein Konto in Italien benennt, die Parteien aber aus Deutschland und Spanien kommen, haben italienische Gerichte keine besondere Sachnähe. Abstellen könnte man dann genauso gut oder besser auf den Ort der Überweisung als Ort der Kredithingabe. Das letzte Wort scheint noch nicht gesprochen.

[value] => Los contratos de préstamos transnacionales pueden ser objeto de conflicto en cuanto a la determinación de la competencia judicial. Esto es lo que le sucedió a una demandante en un proceso ante la Audiencia Territorial de Bielefeld (sentencia de 20.07.2016, exp. 3 O 206/15). La demandante alemana solicitaba el reembolso del préstamo al demandado. Éste tenía al principio su residencia en Alemania, sin embargo, más tarde se mudó a Polonia. En su momento había solicitado que el importe del préstamo fuera pagado en su mayor parte a una cuenta polaca.
Un pequeño gesto con consecuencias importantes - la Audiencia Territorial de Bielefeld declaró la demanda como inadmisible en Alemania, al considerar que los tribunales competentes eran los polacos. El motivo de ello radica en la regulación del Reglamento de Bruselas Ia, una ley que regula a nivel europeo de forma homogénea la competencia internacional. Básicamente, según el Reglamento es posible demandar al demandado en su domicilio. Además, establece de manera especial como tribunal competente el del lugar de cumplimento del contrato. Ahora bien, ¿dónde está el lugar de cumplimiento de un contrato de préstamo? Ya antes de la sentencia comentada aquí, la jurisprudencia había sentado de manera uniforme para todos los contratos que era el lugar de entrega del crédito (véase BGH, sentencia de 28.02.2012, exp. XI ZR 9/11). La Audiencia Territorial de Bielefeld consideró que tal lugar era aquel en el que se había hecho el ingreso de las cantidades, por lo tanto, Polonia.
Esta clasificación no es excluyente. Las competencias judiciales especiales deben posibilitar a fin de cuentas la competencia de un tribunal con especial proximidad al caso. Cuando el prestatario, por ejemplo, indica una cuenta en Italia, pero las partes son de Alemania y España, los tribunales italianos no tienen ninguna proximidad especial. Quizás podría establecerse como lugar de entrega del crédito el lugar de la transferencia. Incluso sería mejor. Todavía no se ha dicho la última palabra.
