[value] => Innerhalb der Europäischen Union funktioniert inzwischen auch die Zustellung von Zivilklagen gut. Es gibt dafür seit mehr als zehn Jahren eine EU-Verordnung, welche die Formalitäten und die Zuständigkeiten der einzelnen nationalen Behörden für solche Zustellungsvorgänge regelt. Doch immer wieder kommt es in der Praxis vor, dass Klagen zugestellt werden sollen, die nicht den formalen Voraussetzungen der Verordnung entsprechen. Insbesondere ist dies dann der Fall, wenn Klagen aus dem Ausland nicht mit der erforderlichen Übersetzung versehen worden sind. Der Empfänger einer solchen Klagezustellung steht dann vor der Frage, ob er die Annahme verweigern kann. Dann kommen auch die üblicherweise mit der Klagezustellung gesetzten Fristen, gegebenenfalls sogar die Anordnung eines Verhandlungstermins, nicht zu Wirkung.
Voraussetzung für eine wirksame Annahmeverweigerung ist nach der Verordnung, dass die zuzustellenden Schriftstücke weder in der Sprache verfasst sind, die der Empfänger versteht, noch in einer Amtssprache des Empfangsmitgliedstaats. Der Empfänger eines zustellenden Schriftstücks soll nämlich in der Lage sein, den Inhalt der Klageschrift ohne Hinzuziehung eines Übersetzers zur Kenntnis nehmen zu können. Wenn die Klage nicht in der vorgeschriebenen Weise übersetzt ist, kann der Empfänger das Schriftstück binnen einer Woche an die sogenannte Empfangsstelle zurücksenden. Das Übersetzungserfordernis gilt allerdings nach der Rechtsprechung des Europäische Gerichtshofs nicht für beigefügte Anlagen.
Wenn die Annahme des zuzustellenden Schriftstücks wirksam verweigert worden ist, muss der Kläger die Zustellung erneut unter Beachtung der entsprechenden Übersetzungsvorschriften zustellen lassen.

Desde hace más de diez años existe a este respecto un Reglamento Europeo que regula los trámites y las competencias de cada una de las autoridades nacionales para tal proceso de notificación. Sin embargo, en la práctica, suele ocurrir a menudo que las demandas sean notificadas sin que se cumplan con los requisitos que el Reglamento establece. Así ocurre, en particular, cuando no se acompaña a la demanda proveniente del extranjero de la necesaria traducción. Al destinatario de tal notificación de demanda le surgirá entonces la cuestión de si puede negarse a la aceptación. En este caso, los plazos normalmente establecidos con la notificación de la demanda o, en su caso, la disposición de la fijación de una vista oral, no surtirán efectos.
Para que la negativa de aceptación sea eficaz, el Reglamento establece como requisito que el documento que se notifique no esté redactado ni en una lengua que el destinatario entienda ni en una de las lenguas oficiales del Estado miembro requerido. En concreto, el destinatario de un documento notificado debe poder conocer el contenido del escrito sin la intervención de un traductor. Si la demanda no está traducida de la forma prescrita, el destinatario podrá devolver el documento al organismo receptor en el plazo de una semana. No obstante, de conformidad con la jurisprudencia del Tribunal de Justicia de la Unión Europea, el requisito de traducción no se aplica a la documentación adjunta.
Si la aceptación del documento notificado se hubiera negado de forma eficaz, el demandante deberá procurar que la notificación se realice de nuevo teniendo debidamente en cuenta las disposiciones correspondientes a las traducciones.
