[value] => Am 1. Januar 2017 traten die Änderungen der Durchführungsverordnung (EU) Nr. 282/2011 in Kraft, die die Auslegung der Regelungen zur Ortsbestimmung bei direkt mit Immobilien verbundenen Dienstleistungen betreffen.
Diese sind in Art. 47 der Umsatzsteuerrichtlinie und in Art. 70 Abs. 1 Nr. 1 des spanischen Umsatzsteuergesetzes enthalten. Die Änderungen erfolgten durch die Einfügung der Artikel 13ter, 31bis und 31ter in die erwähnte Verordnung, und zwar aufgrund der Durchführungsverordnung (EU) Nr. 1042/2013 des Rates.
Durch die Änderungen wird eine besondere Regelung eingeführt, die die Besteuerung in dem Mitgliedstaat erlaubt, in dem die Dienstleistung erbracht wird. Vor dem Hintergrund der unterschiedlichen Auslegungen in den Mitgliedstaaten wird – neben der Konkretisierung des Begriffes der Immobilie – ein neues Verständnis der mit Immobilien verbundenen Dienstleistungen geschaffen. Dies geschieht mit dem Ziel genauer zu bestimmten, welche von Art. 47 der Umsatzsteuerrichtlinie und Art. 70 Abs. 1 Nr. 1 des spanischen Umsatzsteuergesetzes umfassten Leistungen eine „ausreichend direkte Verbindung“ mit den Gütern haben, so dass auf sie Art. 70 des Gesetzes Anwendung finden kann.
Das Konzept der „ausreichend direkten Verbindung“ wird durch eine nicht abschlieβende Aufstellung definiert. Aufgrund des Vorrangs des europäischen Rechts gegenüber dem nationalen Recht muss die Regelung zur Ortsbestimmung in Art. 70 Abs. 1 Nr. 1 des spanischen Gesetzes unter Berücksichtigung der Vorgaben des europäischen Rechts ausgelegt werden, das nach seinem Inkrafttreten ohne Notwendigkeit einer Umsetzung direkt Anwendung findet.

[value] => El pasado 1 de enero de 2017 entraron en vigor las modificaciones operadas en el Reglamento de Ejecución (UE) 282/2011, relativas a la interpretación de las reglas de localización de los servicios directamente relacionados con bienes inmuebles contenidas en el artículo 47 de la Directiva IVA y recogidas en el artículo 70.Uno.1º de nuestra Ley IVA.
Dichas modificaciones se realizaron mediante la inclusión de los artículos 13 ter, 31 bis y 31 ter en el reglamento citado, a través del Reglamento de Ejecución 1042/2013, del Consejo. Constituyen el establecimiento de una regla particular cuya finalidad es la de permitir la imposición en el estado miembro en el que el servicio se consuma. Para ello, y dadas las divergencias interpretativas existentes entre los distintos estados miembros, además de concretarse la noción de bien inmueble, se establece una nueva configuración de los servicios vinculados a bienes inmuebles, con el objeto de determinar, de una manera más precisa, cuáles de los contemplados por el artículo 47 de la Directiva IVA y recogidos en el artículo 70.Uno.1º tienen una „vinculación suficientemente directa“ con los bienes en cuestión y, por lo tanto, son susceptibles de aplicar la regla prevista en el mencionado artículo 70.
El concepto de „vinculación suficientemente directa“, es precisado mediante el detalle de una relación incluyente, no cerrada. Bajo el principio de primacía de la normativa reglamentaria comunitaria sobre la normativa nacional, la regla de localización de estos servicios, contenida en el artículo 70.Uno.1º, debe de ser interpretada y aplicada bajo los parámetros establecidos en esta norma reglamentaria comunitaria, siendo directamente aplicable sin necesidad de trasposición a la normativa interna una vez que ha entrado en vigor.
