[value] => Unternehmen, die in den letzten 12 Monaten durchschnittlich 50 oder mehr Arbeitnehmer beschäftigt haben, sind nach dem Allgemeinen Gesetz über Personen mit Behinderung und ihre soziale Eingliederung dazu verpflichtet, mindestens 2% an Arbeitnehmern mit Behinderung (d.h., ein Grad von über 33 %) einzustellen.
Ausnahmsweise kann ein Unternehmen jedoch von dieser Verpflichtung befreit werden. Dazu muss es einen Antrag beim SEPE (Spanisches Arbeitsamt) stellen, und Folgendes nachweisen:
- dass das SEPE keine geeigneten oder interessierten Bewerber für die vom Unternehmen ausgeschriebene Stelle angeboten hat; und
- dass es organisatorische, technische, produktive oder wirtschaftliche Gründe gibt, die gegen die Einstellung von Personen mit Behinderung sprechen (so z.B. die Vornahme von gefährlichen Arbeiten).
Das SEPE muss innerhalb von zwei Monaten auf den Antrag antworten, sonst gilt die Genehmigung als erteilt. Nach drei Jahren muss das Unternehmen das Ausnahmeverfahren allerdings erneut durchlaufen und einige der folgenden alternativen Maßnahmen tätigen:
- Einen handels- oder privatrechtlichen Vertrag zur Versorgung mit Rohstoffen, Maschinen oder sonstigen für das Unternehmen notwendigen Gütern mit einem Beschäftigungszentrum oder einem selbstständigen Erwerbstätigen mit Behinderung unterzeichnen;
- Einen handels- oder privatrechtlichen Dienstleistungsvertrag mit einem Beschäftigungszentrum oder einem selbstständigen Erwerbstätigen mit Behinderung unterzeichnen;
- Geldliche Spenden an eine gemeinnützige Vereinigung zur Förderung der Berufsausbildung, Eingliederung in die Arbeitswelt und der Errichtung von Arbeitsstellen für Personen mit Behinderung leisten;
- Die Einrichtung einer Arbeitsplatzermöglichung unter vertraglicher Einbeziehung eines amtlichen Beschäftigungszentrums.

[value] => De acuerdo con la ley vigente en España, las empresas que en los últimos 12 meses hayan tenido un promedio de 50 trabajadores o más están obligadas a contratar al menos a un 2% de trabajadores con discapacidad (con un grado igual o superior al 33%).
No obstante, existe la posibilidad de que las empresas queden exentas total o parcialmente de esta obligación, mediante la solicitud expresa al SEPE (Servicio Público de Empleo Estatal), acreditando en su solicitud:
- Que ha presentado una oferta de trabajo para este colectivo en el SEPE y no ha encontrado candidatos idóneos o interesados
- Que existen causas productivas, organizativas, técnicas o económicas que dificultan la contratación de personas con discapacidad (por ejemplo, si la empresa desarrolla trabajos peligrosos que no pueden ser desempeñados por este colectivo)
Una vez presentada la solicitud, el SEPE tendrá dos meses para contestar. La falta de respuesta se considerará como solicitud aceptada por silencio administrativo positivo. La declaración de excepcionalidad tendrá una validez de tres años, al cabo de los cuales la empresa deberá reiniciar de nuevo el procedimiento de exención y adoptar alguna de las siguientes medidas:
- La celebración de un contrato mercantil o civil con un centro especial de empleo, o con un trabajador autónomo con discapacidad, para el suministro de materias primas, maquinaria o bienes de equipo necesarios para el normal desarrollo de la actividad de la empresa
- La celebración de un contrato mercantil o civil con un centro especial de empleo, o con un trabajador autónomo con discapacidad, para la prestación de servicios ajenos y accesorios a la actividad normal de la empresa
- La realización de donaciones y acciones de patrocinio, de carácter monetario, para el desarrollo de actividades de inserción laboral y de creación de empleo de personas con discapacidad
- La constitución de un enclave laboral, previa suscripción del correspondiente contrato con un centro especial de empleo.
