[value] => Im Durchschnitt verdienen Frauen in Deutschland derzeit immer noch 21 Prozent weniger als Männer. Selbst wenn man berücksichtigt, dass Frauen öfter als Männer Teilzeitmodelle nutzen und seltener in Führungspositionen aufsteigen, verbleibt immer noch ein durchschnittlich 7 Prozent niedrigerer Lohn im Vergleich zu den männlichen Kollegen. Um diese Lohnungerechtigkeit zu bekämpfen, hat das Bundeskabinett am 11.01.2017 ein Gesetz zur Förderung der Transparenz von Entgeltstrukturen beschlossen. Der Bundestag hat am 16.02.2017 über den Gesetzesentwurf beraten. Geschaffen wurde eine Rechtsgrundlage, die den Arbeitnehmern in Unternehmen ab 200 Beschäftigten einen Auskunftsanspruch hinsichtlich ihrer eigenen Entlohnung im Vergleich zu der Bezahlung von Kollegen und Kolleginnen mit einer gleichen oder vergleichbaren Tätigkeit gewährt. Der Arbeitgeber ist aber nicht verpflichtet, die Gehälter einzelner Mitarbeiter preiszugeben. Vielmehr muss er nur Auskunft über ein durchschnittliches monatliches Bruttoentgelt von Mitarbeitern des jeweils anderen Geschlechts mit der gleichen oder zumindest einer vergleichbaren Tätigkeit geben. Der Gesetzesentwurf verpflichtet zudem sogenannte lageberichtspflichtige Unternehmen, also Kapitalgesellschaften mit mehr als 500 Arbeitnehmern, regelmäßig über Maßnahmen zur Gleichstellung und zur Entgeltgleichheit in ihrem Unternehmen zu berichten. In tarifgebundenen Unternehmen macht der Betriebsrat den Auskunftsanspruch geltend. In solchen ohne Betriebsrat können sich die Arbeitnehmer direkt an ihren Arbeitgeber wenden.
Das Institut für Wirtschaftsprüfer begrüßt den neuen Gesetzes-entwurf vollumfänglich. Der Gewerkschaftsbund („DGB“) äußert sich ebenfalls positiv über den Entwurf. Das bestehende Tabu, nicht über Gehälter sprechen zu dürfen, würde hiermit aufgehoben. Allerdings hofft Elke Hannack, die stellvertretenden Vorsitzende des DGB, noch auf Verbesserungen des Entwurfs. Der Auskunftsanspruch solle für alle Betriebe gelten und nicht nur für solche ab 200 Beschäftigten.

Aun teniendo en cuenta que las mujeres se benefician en mayor medida de jornadas a tiempo parcial y ascienden con menor frecuencia a puestos directivos, sigue existiendo una diferencia salarial media del 7% con respecto a sus compañeros varones. Para luchar contra esta desigualdad, el Consejo de Ministros aprobó el 11 de enero un proyecto de ley de promoción de la transparencia salarial, que fue debatido el 16 de febrero en el Bundestag.
Se ha definido la base jurídica que otorga a los trabajadores de empresas con más de 200 empleados el derecho a conocer el salario de compañeros o compañeras que desempeñen una actividad profesional equiparable. No obstante, el empresario no está obligado a revelar el salario de ningún trabajador en concreto, sino que solamente deberá facilitar información sobre el salario bruto medio mensual de los trabajadores del otro sexo que realicen tareas idénticas o al menos equiparables.
Asimismo, de acuerdo con el proyecto de ley, las empresas obligadas a presentar informe de gestión, es decir, las sociedades de capital con más de 500 empleados, deberán informar con regularidad sobre sus políticas de igualdad de género e igualdad salarial. En empresas sujetas a convenios colectivos es el comité de empresa el encargado de hacer valer este derecho, mientras que en las que no cuentan con comité de empresa, los trabajadores pueden dirigirse directamente a su empleador.
Tanto el instituto de auditores financieros como la Confederación de Sindicatos Alemanes (DGB) acogen favorablemente el nuevo proyecto de ley, que acabará con el actual tabú que impide hablar sobre salarios.
La vicepresidenta de la Confederación de Sindicatos Alemanes, Elke Hannack, espera sin embargo una mejora del proyecto. El derecho a conocer debe poder ejercerse en todas las empresas, no solo en las que tienen más de 200 empleados.
