[value] => Der EuGH hat im Juli 2016 (C-494/15) entschieden, dass ein Mieter von Markthallen, der die verschiedenen in diesen Hallen befindlichen Verkaufsflächen an Händler untervermietet, von denen einigen ihren Stand zum Verkauf von Fälschungen von Markenerzeugnissen nutzen, als Mittelsperson im Sinne des europäischen Rechts anzusehen ist. Nach Ansicht des EuGH ist es unbeachtlich, ob Verkaufsstellen auf einem Online-Marktplatz oder auf einem physischen Handelsplatz wie etwa in einer Markthalle zur Verfügung gestellt werden. Damit sind die Vermieter unabhängig von ihrer etwaigen eigenen Verantwortlichkeit gezwungen, Maßnahmen, mit denen diese Verletzungen abgestellt werden sollen, sowie Maßnahmen zur Vorbeugung gegen erneute Verletzungen zu treffen, sobald die Vermieter die Erstverletzungen zur Kenntnis nehmen.
Diese Entscheidung könnte nicht nur für Betreiber und Vermieter physischer Handelsplätze im engeren Sinn, sondern auch für Vermieter und Betreiber von Einkaufs- und Fachmarktzentren – als Handelsplätze im weiteren Sinn – Anwendung finden. Das kann auch für die Vermieter in Deutschland bedeuten, dass sie verklagt werden können, wenn ihre Mieter Fälschungen von Markenprodukten in den Mietflächen verkaufen. Es genügt dabei nicht, dies im Mietvertrag ausdrücklich als unzulässig zu vereinbaren. Vermieter müssen also nicht nur den Verkauf von Fälschungen im Mietvertrag verbieten, sondern bei etwaigen Verstößen mit allen rechtlichen Mitteln reagieren (z.B. Abmahnung des Mieters und – im Fall der Fortsetzung des Vertreibens von Fälschungen – eine Unterlassungsklage wegen fortgesetzten vertragswidrigen Gebrauchs der Mietsache) sowie in Notfällen eine außerordentliche Kündigung des Mietverhältnisses.

[value] => El TJCE ha decidido en julio de 2016 (C-494/15) que al arrendatario de un mercado cubierto que subarrienda los diferentes puestos de venta situados en dicho mercado a comerciantes, algunos de los cuales utilizan su puesto para vender mercancías que constituyen falsificaciones de productos de marca, se debe considerar como un intermediario a tenor del derecho europeo. En opinión del TJCE, no es relevante el hecho de que la puesta a disposición de puestos de venta se refiera a un mercado electrónico o a un mercado físico, como los mercados cubiertos. Con ello, los arrendadores, tan pronto como tomen conocimiento de las vulneraciones, están obligados, con independencia de su propia responsabilidad, a adoptar medidas al objeto de que cesen las infracciones y medidas al objeto de prevenir nuevas infracciones.
Esta decisión podría aplicarse no sólo para operadores y arrendadores de plazas comerciales físicas en el sentido estricto, sino también para arrendadores y operadores de centros comerciales y parques comerciales, en tanto que superficies comerciales en el sentido más amplio. Esto puede significar también para los arrendadores en Alemania que puedan ser demandados, en caso de que sus arrendatarios vendan productos de marca falsificados en las superficies arrendadas. Para evitarlo no basta con que los arrendadores pacten expresamente en el contrato de arrendamiento que no está permitida la venta de falsificaciones, sino que en caso de vulneración de esta obligación por parte del arrendatario, tienen que reaccionar con todos los instrumentos jurídicos a su disposición (p.ej. requerimiento del arrendatario y, en caso del mantenimiento de la venta de falsificaciones, ejercicio de la acción de cesación por el uso continuado indebido del objeto de arrendamiento), así como en caso necesario, la resolución extraordinaria del contrato de arrendamiento.
