[value] => Am vergangenen 2. Februar hat ein Gericht in Madrid die Klage von CONFEBUS, ein Verband zur Vertretung der Interessen der spanischen Busunternehmen, gegen die Inhaber der Webseite www.blablacar.es, ein Webportal zur Vermittlung von Mitfahrdiensten für Autofahrten, abgewiesen.
CONFEBUS argumentierte, dass die Aktivitäten von BlaBlaCar einen unlauteren Wettbewerb darstellen, da es als Transportunternehmen agiert, ohne die entsprechenden Genehmigungen erhalten zu haben, zumal die Strecke per Sitzplatz bezahlt wird, Bearbeitungskosten entstehen, Transportuhrzeiten angegeben und der Service mit einer Bankkarte bezahlt wird. BlaBlaCar hingegen behauptete, dass keinerlei Transportvorschriften verletzt werden und beschreibt sich als eine Online-Plattform für Informations- und Übertragungsdienste in elektronischen Netzwerken, wo keinerlei Vergütung oder Gewinn für die Passagiere oder Fahrer entstehen und darüber hinaus letztere keine Mitarbeiter von BlaBlaCar sind.
In seiner Entscheidung von über 26 Seiten erklärt der Richter nach Bewertung der entsprechenden Argumentationen, dass BlaBlaCar als Geschäftsgegenstand nicht die „Organisierung“ der Beförderung von Personen hat, sondern lediglich Menschen in Verbindung setzt, die gemeinsam eine bestimmte Reise machen und die jeweiligen Kosten aufteilen möchten. Es ist dabei ausschlaggebend, dass die Fahrer weder von BlaBlaCar beschäftigt werden noch einem Transportunternehmen zugehörig sind. Es geht lediglich um die Aufteilung der Kosten. Zusammenfassend ist die Aktivität von BlaBlaCar daher im Rahmen des privaten Transports zu verstehen, da nicht die gesetzlichen Voraussetzungen für öffentliche Verkehrsmittel erfüllt sind. Dieses Urteil stellt einen ersten Sieg der Kollaborativen Wirtschaft dar; bestimmte Sektoren werfen bereits die Fragen auf, inwieweit diese Entscheidung einen Einfluss auf das zurzeit anhänginge Verfahren zwischen Fedtex, als Vertreter der spanischen Taxifahrer, und dem Weltunternehmen UBER haben wird.

[value] => El pasado 2 de febrero un Juzgado de Madrid desestimó la demanda presentada por CONFEBUS, la Confederación que representa a las empresas de autobuses españolas, contra las sociedades que gestionan la web www.blablacar.es, de intermediación de servicios de vehículos compartidos para viajes en coche.
CONFEBUS alegaba que BlaBlaCar realiza competencia desleal, al actuar como empresa de transporte sin contar con las autorizaciones necesarias, pues el viaje se abona por plaza, tiene gastos de gestión, horario de viaje y desplazamiento y abono a través de una tarjeta bancaria, etc. BlaBlaCar se defendía argumentando principalmente que no infringe las normas de transporte, ya que se define como una plataforma online que presta servicios de transmisión e intercambio de información en redes electrónicas y no hay remuneración o lucro ni para pasajeros ni para conductores, que no son empleados de BlaBlaCar.
En su resolución, de hasta 26 páginas, el magistrado, tras valorar las alegaciones de las partes, sostiene finalmente que Blablacar no tiene como objeto empresarial “organizar” el transporte de viajeros por carretera, sino que meramente pone en contacto a personas que quieren realizar un viaje juntos y compartir determinados gastos. Es relevante al respecto que los conductores no estén contratados por Blablacar, ni pertenezcan a una empresa o a una industria dedicada al transporte, y que los conductores tengan como objetivo meramente el “compartir costes”. En definitiva, la actividad que realiza BlaBlaCar debe entenderse como comprendida en el ámbito del transporte privado, al no reunir las características legalmente establecidas para ser considerada transporte público. Esta sentencia representa una importante victoria para la denominada economía colaborativa, y algunos sectores se plantean si puede tener incidencia sobre el pleito que actualmente está pendiente entre la organización Fedtex, que representa a los taxistas españoles, y la empresa internacional UBER.
