[value] => Das OLG Düsseldorf hat Millionenbußen des Kartellamts gegen führende Süßwarenhersteller bestätigt.
Das Bundeskartellamt hatte im Jahre 2013 Bußgelder von insgesamt über 14 Mio. EUR gegen verschiedene Süßwarenhersteller sowie den Verband der deutschen Süßwarenindustrie verhängt. Grund war ein kartellrechtswidriger Informationsaustausch. Manche Unternehmen – darunter Haribo, Katjes, Kraft, Storck, Zentis – akzeptierten die Bußgeldbescheide. Andere, wie Bahlsen, Griesson de Beukelaer und Feodora, sowie der Bundesverband der Deutschen Süßwarenindustrie, legten beim OLG Einspruch ein gegen die Entscheidung des Bundeskartellamtes.
Ergebnis: Das OLG hat nicht nur das Bundeskartellamt in seiner Entscheidung bestärkt. Vielmehr hat es die Bußgelder erhöht auf 21 Mio. – da es den Gesamtumsatz der Unternehmen zu Grunde legte und nicht, wie das Bundeskartellamt, lediglich den Umsatz in Deutschland.
Das Besondere an der Entscheidung ist, dass es keine koordinierten Preisabsprachen gegeben haben soll, wohl aber einen regelmäßigen kartellrechtswidrigen Informationsaustausch über die Verhandlungen mit dem Lebensmittel-einzelhandel. So führt der Präsident des BKartA aus, dass „das Oberlandesgericht noch einmal bestätigt [hat], dass nicht nur klassische Absprachen zwischen Unternehmen kartellrechtlich verboten sind, sondern dass Unternehmen auch keine wettbewerblich sensiblen Informationen austauschen dürfen.“
Abzuwarten bleibt allerdings eine etwaige Entscheidung des BGH, sollten die Betroffenen noch Rechtsmittel einlegen bzw. eingelegt haben.

El Tribunal de Defensa de la Competencia Alemán ha sancionado en el año 2013 a varias empresas productoras de dulces y a la Asociación Federal Alemana de la industria de dulces con multas de más de 14 mill. de euros. La causa fue un intercambio de información que infringe las normas de la competencia leal. Algunas de las empresas afectadas aceptaron la multa, entre ellas Haribo, Katjes, Kraft, Storck y Zentis. Otras, como Bahlsen, Griesson de Beukelaer y Feodora, igual que la Asociación Federal Alemana de la industria de dulces, interpusieron recurso contra la decisión ante el Tribunal Regional contra la decisión.
El resultado: El Tribunal Regional Superior no sólo ha apoyado al Tribunal de Defensa de la Competencia en su decisión. Además, ha elevado las multas a aprox. 21 mill. de euros, dado que tomó como base de cálculo las cifras de las ventas globales, y no – como el Tribunal de Defensa de la Competencia – solamente las ventas en Alemania.
Lo particular de la decisión consiste en que no constaba la existencia de habituales acuerdos sobre precios, si no un mero intercambio de información que puede infringir las normas de competencia leal en ciertos casos. El Presidente del Tribunal de Defensa de la Competencia Alemán expone que “el Tribunal Regional Superior ha confirmado una vez más, que no son sólo los acuerdos sobre precios que están prohibidos según el derecho de competencia, sino también un intercambio de información sensible.”
Habrá que esperar si las partes interponen - o han interpuesto - un recurso ante el Tribunal Supremo Alemán, y qué decidirá éste en su caso.
