[value] => In dem Gesetz einer Comunidad Autónoma aus dem letzten Jahr (Ley 8/2016) heißt es dort in Art. 30 sinngemäß: „Beweislastumkehr 1) In Übereinstimmung mit dem Prozess- und dem Verwaltungsverfahrensrecht gilt, dass wenn die klagende Partei oder der Interessierte eine Verletzung behauptet... und fundierte Hinweise beibringt, so obliegt es der verklagten Seite oder demjenigen, dem die Rechtsverletzung vorgeworfen wird, eine objektive, nachvollziehbare Rechtfertigung über getroffene Maßnahmen und ihre Angemessenheit beizubringen, die hinreichend bewiesen sind...“
Eine Beweislastumkehr in einer öffentlich-rechtlichen Norm ist wenigstens überraschend, denn in der spanischen Verfassung ist die Unschuldsvermutung in Artikel 24 garantiert. Und das spanische Verfassungsgericht hat dies bestätigt, so z.B. deutlich in seinem Urteil vom 26.4.1990, STC 76/1990: „die Beweislast obliegt dem Kläger; niemand ist verpflichtet, seine Unschuld zu beweisen…“. Vergleichbare Regelungen finden wir auch bei Gesetzen anderer Comunidades Autónomas.
Stehen wir in Spanien vor einer Entwicklung, dass die jeweiligen Regierungen einzelner Gebietskörperschaften das höchste Gesetz – die spanische Verfassung – nur nach ihrem Gutdünken beachten? Dies wäre bedenklich, das spanische Tribunal Constitucional ist aufgerufen, für verfassungsgemäße Verhältnisse Sorge zu tragen.

“Artículo 30 - Inversión de la carga de la prueba 1) De acuerdo con lo que establecen las leyes procesales y reguladoras de los procedimientos administrativos, cuando la parte actora o la interesada aleguen... y aporten indicios fundamentados, corresponde a la parte demandada o a quien se impute la situación discriminatoria, la aportación de una justificación objetiva y razonable, suficientemente probada, de las medidas adoptadas y de su proporcionalidad.”
Menos mal que no se trata de una Ley tributaria, si no, el contribuyente lo tendría aún más difícil en inspecciones. Pero, a mi entender, la constitucionalidad de esta norma es cuestionable, a pesar de la coletilla en el apartado 4: Lo que establece el apartado 1 anterior no es aplicable en los procesos penales ni a los procedimientos administrativos sancionadores. Entonces, ¿para qué sirve el apartado 1? Si miramos la Constitución Española:
“Artículo 24 Asimismo, todos tienen derecho al .... a no confesarse culpables y a la presunción de inocencia.”
Entendemos que los juzgados defienden este principio. La presunción de inocencia es una garantía que obliga a quien acusa a demostrar la culpabilidad del inculpado. El Tribunal Constitucional ha fallado en su sentencia 76/1990 del 26 de abril: “24.2 … EN TAL SENTIDO, EL DERECHO A LA PRESUNCIÓN DE INOCENCIA COMPORTA: QUE LA SANCIÓN ESTE BASADA EN ACTOS O MEDIOS PROBATORIOS DE CARGO O INCRIMINADORES DE LA CONDUCTA REPROCHADA; QUE LA CARGA DE LA PRUEBA CORRESPONDA A QUIEN ACUSA, SIN QUE NADIE ESTE OBLIGADO A PROBAR SU PROPIA INOCENCIA; Y QUE CUALQUIER INSUFICIENCIA EN EL RESULTADO DE LAS PRUEBAS PRACTICADAS, LIBREMENTE VALORADO POR EL ORGANO SANCIONADOR, DEBE TRADUCIRSE EN UN PRONUNCIAMIENTO ABSOLUTORIO...”
¿Conocen los redactores del mencionado artículo la Constitución y el TC? Por muy buena causa que pretendo defender, los límites del poder público y los derechos constitucionales de los ciudadanos deberían ser respetados por los legisladores. El ejercicio de un poder público, que no garantiza la presunción de inocencia del inculpado, no cabe en un estado democrático.
