[value] => Die Bundesregierung hat am 01.02.2017 den vom Bundesinnenminister vorgelegten Gesetzentwurf zur Anpassung des Bundesdatenschutzgesetzes an die EU-Datenschutz-Grundverordnung beschlossen.
Herzstück des Gesetzentwurfs ist die Neukonzeption des Bundesdaten-schutzgesetzes. Es ergänzt künftig die unmittelbar geltende Datenschutz-Grundverordnung um die Bereiche, in denen den Mitgliedstaaten Gestaltungsspielräume verbleiben. Die Anpassungen sind jedoch so gering, dass man dennoch von einer vollständigen Harmonisierung des europäischen Datenschutzrechtes sprechen kann.
Bundesinnenminister Dr. Thomas de Maizière glaubt, mit der Anpassung des Bundesdatenschutzgesetzes mache Deutschland einen wichtigen Schritt zur europarechtlichen Vereinheitlichung der Datenschutzregelungen.
Der Digitalverband Bitkom äußert sich eher kritisch zu dieser Anpassung. Es sei ein langer Weg gewesen, eine europaweite einheitliche Regelung zu schaffen. Dieses Ergebnis dürfe nicht durch nationale Alleingänge zunichte gemacht werden, sagt Bitkom-Geschäftsleiterin Susanne Dehmel. Um für internationale Wettbewerbsgleichheit zu sorgen, fordert der Verband für europaweit tätige Unternehmen einheitliche datenschutzrechtliche Regelungen.
Um den Datenschutz weiter auszubauen, ist darüber hinaus die Einführung eines EU-einheitlichen Mindestalters, ab welchem man Soziale Medien nutzen kann, im Gespräch. In Deutschland gibt es eine solche Altersgrenze bisher nicht. Bitkom-Geschäftsleiterin Susanne Dehmel ist aber der Auffassung, der Zugang zu digitalen Informations- und Bildungsangeboten gehöre zu den grundlegenden Rechten von jungen Menschen. Dieser Zugang dürfe nicht mit Verweis auf den Datenschutz verhindert werden. Nach überwiegender Auffassung ist aber eine europaweite einheitliche Altersgrenze erforderlich, damit Anbieter sozialer Dienste nicht für jedes Land Anpassungen vornehmen müssen.

[value] => El gobierno federal aprobó el 1 de febrero de este año el proyecto de ley presentado por el ministro del Interior para la adaptación de la Ley federal de protección de datos al Reglamento general de protección de datos de la Unión Europea.
El elemento central de este proyecto es la reforma de la Ley federal de protección de datos para adaptarla al Reglamento general de la Unión Europea (de aplicación directa) en los ámbitos en que los Estados miembros disponen de margen de apreciación. No obstante, las modificaciones son tan limitadas que puede hablarse de una armonización completa del derecho europeo de protección de datos.
Según el ministro del Interior, Thomas de Maizière, con la adaptación de la Ley federal Alemania da un importante paso hacia la armonización de las normativas europeas en materia de la protección de datos.
La asociación digital Bitkom ha criticado esta reforma. Su presidenta, Susanne Dehmel, ha señalado que queda un largo camino hasta conseguir una armonización normativa en toda Europa y que las decisiones nacionales individuales no deben malograr tal resultado. La asociación reclama normas de protección de datos armonizadas para las empresas que operan a escala europea a fin de asegurar que compitan en igualdad de condiciones.
Para reforzar aún más la protección de datos, se está discutiendo también la introducción de una edad mínima común para utilizar las redes sociales en la Unión Europea. En Alemania no existe tal edad mínima. La presidenta de Bitkom considera que el acceso a información y oportunidades formativas digitales es un derecho fundamental de los jóvenes. La protección de datos no debe obstaculizar dicho acceso.
No obstante, de acuerdo con la opinión predominante, es indispensable una edad mínima común en toda Europa para que los proveedores de servicios de redes sociales no necesiten adaptarse a cada país.
