[value] => Exportkontrollvorschriften dienen der Umsetzung von sicherheits- und außenwirtschaftspolitischen Zielen der Bundesregierung. Zuständig für die Überwachung und die Erteilung von erforderlichen Genehmigungen ist das Bundesamt für Außenwirtschaft und Ausfuhrkontrolle (BAFA). Die Exportkontrolle bezieht sich nicht nur auf strategisch wichtige Güter, wie Waffen und Rüstungsgüter, sondern auch auf Güter mit potentiell doppeltem Verwendungszweck (Dual Use-Güter). Dies können Waren, Software oder Technologien sein, die für zivile und militärische Zwecke verwendet werden können; z.B. eine Fräsmaschine, mit der man Bauteile sowohl für zivile wie für militärische Produkte bearbeiten kann.
Für besonders kritische Länder oder Regionen gibt es Embargovorschriften und hierzu gehören derzeit beispielsweise der Iran (auch wenn inzwischen stark gelockert), Libyen, Nordkorea, Russland u.a.
In dem Fall eines Verkaufs von High Tech-Produkten in den Iran (zu einer Zeit, als noch die strengen Embargovorschriften galten) hat der Bundesgerichtshof (BGH) eine Entscheidung getroffen, mit der die BestimmungenüberVerkaufsverbotenachderEU-IranEmbargo-Verordnung bzw. des Außenwirtschaftsgesetzes konkretisiert worden sind. Es ging um die Strafbarkeit der Ausfuhr von Satelliten- und Nachrichtentechnik an ein Unternehmen im Iran. Der BGH durch Beschluss vom 09.12.2014 (3StR 62/14) hat klar gestellt, dass ein Verstoß gegen das in der Iran-Embargo-Verordnung enthaltene Ausfuhrverbot nicht erst bei der tatsächlichen Verbringung von Waren und Gütern in das Ausland gegeben ist, sondern bereits der Abschluss des schuldrechtlichen Kaufvertrages ausreichen kann. Dadurch wird die mögliche Strafbarkeit eines Ausfuhrvorgangs deutlich vorverlagert. Diese Entscheidung hat über die Iran-Embargo-Verordnung hinausgehende Bedeutung, da sie auf andere Embargovorschriften übertragbar ist.

[value] => La normativa de control de las exportaciones vehicula la implementación de los objetivos de seguridad y de las políticas económicas de exterior del Gobierno Federal. La autoridad competente para la supervisión y concesión de las autorizaciones necesarias es la Oficina Federal de Economía y Control de las Exportaciones (abreviado en alemán, BAFA). El control de la exportación se refiere no sólo a productos estratégicos importantes, como armamento, también a productos que potencialmente pueden tener doble propósito de uso (productos de doble uso). Éstos pueden ser productos, software o tecnología, cuyo uso puede ser tanto civil como militar; p.ej. una fresadora con la cual se pueden trabajar piezas para productos civiles y militares. Para países o regiones particularmente críticos existen leyes de bloqueo y a este grupo pertenecen actualmente, entre otros, Irán (aunque se ha ido flexibilizando bastante), Libia, Corea del Norte y Rusia. En un caso de venta de productos de alta tecnología en Irán (cuando aún estaban vigentes las estrictas leyes de bloqueo) el Tribunal Federal Supremo alemán (BGH) adoptó una decisión por la cual se concretaba la normativa relativa a la prohibición de venta de acuerdo con el Reglamento europeo sobre la adopción de medidas restrictivas contra Irán así como en virtud de la Ley de Exportaciones. Se trataba de un caso de responsabilidad penal por la exportación a una compañía iraní de tecnología de satélites y de comunicaciones.
El BGH mediante resolución de fecha 09.12.2014 (3StR 62/14) dejó claro que la vulneración de la prohibición de exportación contenida en el mencionado Reglamento europeo no solo se da por el traslado de mercancías y bienes al extranjero, sino que ya la conclusión del contrato obligacional en sí era suficiente. Así la posible responsabilidad penal en una exportación queda claramente adelantada. Esta decisión tiene un significado más allá del mencionado Reglamento europeo, pues puede ser aplicada a otras leyes de bloqueo.
