[value] => Die sozialen Netzwerke wie Facebook und Twitter haben sich in ein neues Spielfeld für die Werbenden verwandelt. Die Marken haben sich für diese Art von Medien entschieden und Prominente engagiert, damit durch diese ihre Werbung andere Benutzer erreicht.
Allerdings passiert es häufig, dass die Regeln, die für die Werbung innerhalb anderer Bereiche gelten, nicht auf diesen Plattformen eingehalten werden, so dass die Linie, die sie von der Schleichwerbung trennt, überschritten wird. Der Verbraucher muss zwischen Werbung und Information unterscheiden können. Aus diesem Grund gelten für das Internet und die sozialen Netzwerke die gleichen Gesetze, die für die Offlinewerbung und kommerziellen Kommunikationen gelten. Das Problem kommt dadurch zustande, dass in Spanien keine Entscheidungen in Bezug auf die Schleichwerbung in den sozialen Netzwerken, die kontinuierlich gegen die Rechtsvorschriften verstossen, vorliegen. Im Gegensatz zu anderen Ländern wie Grossbritannien und USA, wurde in Spanien diesbezüglich noch niemand sanktioniert.
Das Problem besteht nicht in einer Rechtslücke, da die aktuellen Gesetze auch für die Werbung in den sozialen Netzwerken Anwendung finden, sondern darin, dass keine Massstäbe vorliegen, um anzugeben, dass eine kommerzielle Nachricht verschickt wird. Da keine spezifische Verordnung für diese Art von Werbung vorliegt, müssten die vorhanden Rechtsvorschriften herangezogen werden, die festlegen, dass kommerzielle Kommunikationen, die auf elektronische Art und Weise erstellt werden, als solche erkennbar sein müssen, sodass die Begriffe „publi“ oder „publicidad“ („Werbung“) enthalten sein müssen. In Anbetracht dieser Umstände, sollten für die kommerziellen Tweets das Hashtag #publi benutzt werden, um nicht gegen die geltenden Gesetze zu verstossen.

Sin embargo, muchas veces, las reglas que se aplican a la publicidad en otros ámbitos se incumplen en estas plataformas, cruzando así la delgada línea que les separa de la publicidad encubierta. El consumidor debe poder distinguir entre lo que es un anuncio y lo que es una información. Por eso, en internet y en las redes sociales se aplica la misma regulación que existe para la publicidad offline, así como lo estipulado sobre comunicaciones comerciales. El problema surge por la falta de resoluciones en España frente a la publicidad encubierta en las redes sociales que está provocando el continuo incumplimiento de la normativa vigente. A diferencia de otros países como Reino Unido o Estados Unidos, en España no se ha sancionado a nadie por este tema.
Y es que el problema real no es un vacío legal, puesto que la legislación existente puede extrapolarse a la publicidad realizada en redes sociales, sino falta de estándares para poder indicar que se está enviando un mensaje comercial. A falta de un reglamento específico para este tipo de publicidad, se debería tener en cuenta la legislación vigente que impone que las comunicaciones comerciales realizadas por vía electrónica sean claramente identificables como tales, contemplando la inclusión de los términos publi o publicidad. Teniendo en cuenta esto, se debería utilizar en todos los tuits publicitarios el hashtag #publi para cumplir con la normativa actual.
