[value] => Die spanische Kartellbehörde (CNMC) hat zwei Reiseagenturen, Viajes Halcón und Viajes Barceló, mit einem Bußgeld von insgesamt 1,8 Mio. Euro wegen Nichterfüllung des Beschlusses des Kartellgerichtes vom 25. Oktober 2000 belegt. Gem. Art. 62.4.c) des Wettbewerbsgesetzes stellt dies einen sehr schweren Verstoß dar.
In diesem Verfahren wurden Bußgelder in Höhe von insgesamt 4,5 Mio. Euro gegen vier Reiseagenturen verhängt, die für die öffentliche Ausschreibung der Reisen des IMSERSO (spanisches Institut für Altenpflege und Pflegebedürftigkeit) identische Angebote vorgelegt und, ohne Berücksichtigung des Ausschreibungsergebnisses, eine gemeinsame Ausführung der Reisen mittels der eigens hierzu geschaffenen wirtschaftlichen Interessensgemeinschaft AIE (Agrupación de Interés Económico) vereinbart hatten. Auch wenn die Unternehmen die Geldbußen bezahlt hatten, stellte die CNMC im Zuge ihrer Aufsichtstätigkeit fest, dass die sanktionierten Verhaltensweisen sowie ihre wettbewerbswidrigen Auswirkungen weiterhin stattfanden: die Reiseagenturen ersetzten die früheren Absprachen sowie gemeinsame Ausführung mittels der AIE durch die Gründung einer UTE (temporärer Unternehmenszusammenschluss), welche seitdem jährlich an der Ausschreibung des IMSERSO teilnimmt. Nachdem zwei der beteiligten Reiseagenturen Konkurs anmelden mussten, besteht der Zusammenschluss zurzeit lediglich aus Viajes Halcón und Viajes Barceló. Nach Bewertung der Vertragsmerkmale und –struktur sowie des Umsatzes und der Vorgehensweise der sanktionierten Unternehmen, kommt die CNMC zu der Ansicht, dass weder wirtschaftlich-finanzielle noch technologische Gründe noch Kapazitätsmangel vorlägen, die einen solchen Zusammenschluss für die Teilnahme an den erwähnten Ausschreibungen rechtfertigten. Infolgedessen käme es zu einer Nichterfüllung des Beschlusses von 2000, mit dem die sanktionierten Unternehmen aufgefordert wurden, das wettbewerbswidrige Verhalten einzustellen und nicht erneut aufzunehmen.

[value] => La Comisión Nacional de los Mercados y la Competencia (CNMC) ha sancionado con un total de 1,8 millones de euros a dos agencias de viajes, Viajes Halcón y Viajes Barceló, por incumplir la Resolución del Tribunal de Defensa de la Competencia de 25 de octubre de 2000, lo que según el artículo 62.4.c) de la Ley de Defensa de la Competencia supone una infracción muy grave.
En aquel expediente se impusieron multas por un total de 4,5 millones de euros a cuatro agencias de viajes por presentar ofertas idénticas al concurso público de viajes del IMSERSO y por acordar la ejecución conjunta del mismo, a través de una Agrupación de Interés Económico (AIE) creada a tal fin, independientemente de cuál fuera el resultado de la licitación. Aunque las empresas abonaron las multas, la CNMC detectó en su labor de vigilancia que las conductas sancionadas y sus efectos anticompetitivos siguen produciéndose: las agencias de viajes sustituyeron los antiguos pactos y la ejecución conjunta a través de la AIE, por la creación de una Unión Temporal de Empresas (UTE), que desde entonces se presenta anualmente al concurso del IMSERSO. Dos de las agencias integrantes de la UTE entraron en concurso, por lo que actualmente únicamente se integra por Viajes Halcón y Viajes Barceló. Analizadas las características y estructura de los contratos, el volumen de negocios y la actuación de las empresas sancionadas, la CNMC considera que no existen razones económico-financieras, tecnológicas, o de falta de capacidad para que se justifique el uso de la UTE en los mencionados concursos. Por ello, se declara el incumplimiento de la Resolución del año 2000, en la que se requería a las empresas sancionadas para que cesaran en las conductas anticompetitivas y se abstuvieran de adoptarlas y pactarlas de nuevo.
