[value] => Seit dem 18. Januar 2017 können Gläubiger Ansprüche gegen Schuldner im Ausland auch durch eine grenzüberschreitende Kontopfändung sichern. Die Europäische Union hat hierfür durch Verordnung 655/2014 eine entsprechende Rechtsgrundlage geschaffen, die in allen Mitgliedsstaaten mit Ausnahme von Großbritannien und Dänemark anwendbar ist. Voraussetzung für die grenzüberschreitende Kontopfändung ist, dass der Gläubiger entweder schon einen vollstreckbaren Titel (Urteil, gerichtlicher Vergleich oder notarielle Urkunde) gegen den Schuldner hat oder im Begriff ist, diesen zu erwirken. Außerdem muss er darlegen, dass die Gefahr besteht, dass die eigentliche Vollstreckungsmaßnahme im Ausland wegen der relativ langen Bearbeitungsdauer den Vollstreckungserfolg gefährden würde, weil der Schuldner über das Kontoguthaben in der Zwischenzeit verfügt haben könnte. Der Gläubiger hat den Antrag entweder bei dem Gericht zu stellen, bei dem die Hauptsache anhängig ist oder das sonst zuständig wäre und er muss die erwähnten Voraussetzungen in geeigneter Form vortragen und den Richter von der Dringlichkeit der Maßnahme überzeugen.
In Fällen, in denen die vorläufige Kontopfändung beantragt wird, bevor der Gläubiger die Klage zur Hauptsache erhebt, wird ihm der Richter eine Frist zur Klageerhebung aufgeben (30 Tage nach Einreichung des Antrags oder 14 Tage nach dem Erlass des Beschlusses, je nachdem, welcher Zeitpunkt der spätere ist). Die vorläufige Kontopfändung kann wieder aufgehoben werden, wenn die Klage zur Hauptsache nicht rechtzeitig erhoben wird. Die Maßnahme soll einen Überraschungseffekt haben, d.h. der Schuldner wird erst anschließend darüber in Kenntnis gesetzt. Er kann die Kontopfändung durch Stellung von Sicherheiten (z. B. eine Bankbürgschaft oder eine Grundschuld) abwenden. Die EU-Verordnung ist nicht anwendbar in Fällen, in denen der Schuldner bereits das Insolvenzverfahren beantragt hat oder dies gar schon eröffnet worden ist. Mit der Einführung der grenzüberschreitenden Kontopfändung wird im europäischen Zivilprozessrecht eine wichtige Lücke bei der effektiven Durchsetzung von Ansprüchen im Ausland geschlossen.

[value] => Desde el 18 de enero de 2017 los acreedores pueden asegurar sus derechos frente a sus deudores en el extranjero mediante la orden de retención transfronteriza de sus cuentas. La Unión Europea ha aprobado a través del Reglamento 655/2014 una base jurídica aplicable en todos los Estados miembros, salvo en Gran Bretaña y Dinamarca. Una condición de esta orden de retención es que el acreedor tenga un título ejecutivo (resolución o transacción judicial o documento público) contra el deudor o que esté a punto de obtenerlo. Además, debe indicar que existe el riesgo de que la medida cautelar en el extranjero a causa de un largo proceso comprometa el éxito de la ejecución, pues el deudor durante el ínterin puede disponer de sus saldos. El acreedor tiene que solicitarlo en el Juzgado ante el cual se está juzgando el fondo del asunto o bien ante el que sería competente y debe cumplir los requisitos mencionados, convenciendo al Juez de la urgencia de la medida. En los casos en los que se solicita la orden de retención provisional antes de que el acreedor presente la demanda sobre el fondo del asunto, el Juez le concederá un plazo para la interposición de la demanda (30 días desde la presentación de la solicitud o 14 días desde la promulgación del auto, dependiendo de cuál de los dos acabe más tarde). La orden de retención de cuentas puede ser de nuevo levantada cuando la demanda sobre el fondo no sea presentada dentro de plazo. Estas medidas deben tener un efecto sorpresa, es decir, al deudor le son comunicadas a posteriori. Éste puede impedir la orden de retención a través de presentación de garantías (p.ej. un aval bancario o una garantía hipotecaria).
El Reglamento europeo no es aplicable en los casos en que el deudor haya iniciado un procedimiento de insolvencia o ésta esté ya abierta. Con la introducción de la orden de retención transfronteriza de cuentas se llena un importante vacío del Derecho procesal-civil europeo en cuanto a la imposición efectiva de reclamaciones en el extranjero.
