[value] => Spaniens Oberster Gerichtshof vertritt in seinem Urteil vom 20.06.2016 die Auffassung, dass die so genannten „Strukturen von Kommissionsgeschäften“ für das solche in Auftrag gebende, nicht ansässige, Unternehmen (Kommittent), aufgrund der von dem Kommissionär wahrgenommenen Tätigkeiten, die Gründung einer Betriebsstätte bewirken (im Fall von DELL, das spanische Tochterunternehmen der irischen Gesellschaft DELL PRODUCTS).
Der Oberste Gerichtshof vertritt in diesem Urteil die Ansicht, dass die Dienstleistungen, welche das spanische Tochterunternehmen als Kommissionär seines irischen Mutterhauses erbringt, nach Artikel 5.1 des mit Irland geschlossenen DBA, eine Betriebsstätte dieses Letzteren begründen, da es die Einrichtungen nutzt und ihrer Tätigkeit unmittelbar über das Personal ihres Tochterunternehmens nachgeht, und, nach Artikel 5.5 desselben DBA, da die Voraussetzung des unabhängigen Agenten, welche eine Einordnung als Betriebsstätte ausschlieβen würde, keine Anwendung auf die Beziehungen des Tochterunternehmens mit seinem nicht ansässigen Mutterhaus findet.
Diese Auslegung des Obersten Gerichtshofes folgt dem bereits in früheren Entscheidungen angewandtem Kriterium, weshalb es sinnvoll erscheint, Konzernen zur Vermeidung und/oder Minderung von Steuerrisiken zu empfehlen, ihre Vertriebsstrukturen zu überprüfen.

[value] => El Tribunal Supremo en su sentencia de fecha 20.06.2016 considera que las denominadas “estructuras de comisionista” generan un establecimiento permanente para la entidad comitente no residente por las actividades llevadas a cabo por el comisionista (en el caso DELL, la filial española de la entidad irlandesa DELL PRODUCTS).
En esta sentencia el Tribunal Supremo considera que los servicios que presta la filial española como comisionista a su matriz irlandesa constituyen un establecimiento permanente de ésta última, en base al artículo 5.1 del CDI con Irlanda, al usar las instalaciones y el desarrollar la actividad de forma mediata a través del personal de su filial española, y al artículo 5.5 del mismo CDI, al no ser de aplicación la condición de agente independiente, excluyente de la consideración de establecimiento permanente, a las relaciones de la filial española con su matriz no residente.
La interpretación que realiza el Tribunal Supremo confirma el criterio mantenido en pronunciamientos anteriores, y hace aconsejable que los grupos multinacionales revisen en España sus estructuras de distribución con el fin de evitar y/o reducir riesgos fiscales.
