[value] => Soweit die Erstattung von deutscher Vorsteuer nicht ausnahmsweise im Rahmen einer Umsatzsteuerveranlagung geltend gemacht werden kann (vgl. hierzu unseren Beitrag zum Newsletter Oktober 2013), haben in Deutschland nicht ansässige Unternehmen lediglich die Möglichkeit, diese im Rahmen des Umsatzsteuervergütungsverfahrens (§ 18 Abs. 9 UStG) zu beantragen.
Gemäß § 61 Abs. 2 Satz 3 UStDV in der ab 30.12.2014 geltenden Fassung sind dem Vergütungsantrag auf elektronischem Wege die Rechnungen und Einzelbelege als eingescannte Originale einzureichen. Ausweislich der Gesetzesbegründung sollte hierdurch klargestellt werden, dass mit dem Antrag die eingescannten Originalrechnungen und – einfuhrbelege zu übermitteln sind.
Das Finanzgericht Köln hatte in einem jüngst veröffentlichten Urteil vom 20.01.2016 (2 K 2807/12) über die Frage zu entscheiden, welche Formalanforderungen für die Zeit vor dieser Gesetzesänderung gelten. Im entschiedenen Fall hatte der Kläger eine unstreitig vom Rechnungsaussteller selbst ausgestellte Rechnungskopie elektronisch übersandt, die den Aufdruck „Copy1“ trug. Die Finanzverwaltung vertrat die Ansicht, dass die Gesetzesänderung lediglich eine Klarstellung der bereits zuvor geltenden Gesetzeslage, jedoch keine inhaltliche Änderung sei und Art. 10 der Richtlinie 2008/9/EG vom 12.02.2008 entgegen ihrem ausdrücklichen Wortlaut („Kopie der Rechnung“) einschränkend dahingehend auszulegen sei, dass nur Kopien von Originalrechnungen erstattungsfähig seien. Dem widersprach das Finanzgericht mit dem Argument, das nach Umstellung des Vergütungsverfahrens auf ein telematisches Verfahren aus verfahrensökonomischen Gründen eine Prüfung von Originalbelegen nur noch in begründeten Zweifelsfällen möglich sei (§ 61 Abs. 2 Satz 4 UStDV). Die Finanzverwaltung hat Nichtzulassungsbeschwerde beim Bundesfinanzhof eingelegt (V B 28/16).

[value] => En la medida en que la devolución del IVA alemán soportado no sea aplicable excepcionalmente en el marco de una liquidación por IVA (véase para ello nuestro boletín de octubre de 2013), empresas no residentes en Alemania tienen únicamente la opción de solicitar la devolución en el marco del procedimiento de reembolso del IVA.
De conformidad con el Reglamento sobre el IVA alemán en la versión vigente a partir del 30/12/2014, se deberán presentar telemáticamente junto a la solicitud de devolución, las facturas y los recibos originales escaneados. Con arreglo al objetivo establecido en la exposición de motivos, por medio de la misma, se debía dejar claro que junto con la solicitud, se deben transmitir escaneados los originales de las facturas y de los recibos de importación.
El Tribunal de lo Fiscal de Colonia debía decidir en una sentencia recién publicada el 20/01/2016 sobre la cuestión de cuáles son los requisitos formales que rigen para el periodo anterior a la modificación de la Ley. En el asunto que ha sido objeto de resolución, el demandante había enviado telemáticamente una factura indiscutiblemente expedida por el emisor de la factura, que llevaba la impresión “Copy 1”. La Administración tributaria alemana consideró que la modificación de la Ley simplemente se trataba de una aclaración de la legislación ya existente anteriormente, pero no suponía una modificación del contenido y el Art. 10 de la Directiva 2008/9/EG, en oposición a su redacción expresa, debía interpretarse de forma restrictiva, de manera que solamente copias de las facturas originales pudieran ser objeto de devolución. El Tribunal de lo Fiscal contradijo esta postura con la argumentación de que tras el cambio del proceso de devolución a un proceso telemático por razones de economía procesal, una comprobación del original de los documentos justificativos solamente era posible en justificados casos de duda. La Administración Tributaria alemana ha interpuesto recurso de inadmisión ante el Tribunal Federal Fiscal (V B 28/16).
