[value] => Das Königliche Gesetzesdekret 3/2016, vom 2. Dezember, führt wichtige Änderungen des Körperschaftsteuergesetzes, die u.a. die Ausweitung der Bemessungsgrundlage dieser Steuer zum Ziel haben, ein. Besonderes Augenmerk ist hierbei der Modifizierung des Ausgleichssatzes der Verlustvorträge, also der negativen Bemessungsgrundlagen („BINS“ für „Bases Imponibles Negativas“), zu zollen, kraft derselben mit Wirksamkeitfür das Steuerjahr 2016 folgende Obergrenzen für jene Bemessungsgrundlagen, die vor Anrechnung der Kapitalisierungsrücklage auf den eigentlichen Ausgleich der BINS bestehen, gelten:
a) Für Unternehmen deren Vorjahresnettoumsatzerlös unter 20.000.000 € lag: Der Ausgleich der Verlustvorträge ist auf 60% beschränkt (70% im Steuerjahr 2017).
b) Für Unternehmen deren Vorjahresnettoumsatzerlös mindestens 20.000.000€jedoch weniger als 60.000.000 € betrug: Der Ausgleich der Verlustvorträge ist auf 50% beschränkt.
c) Für Unternehmen deren Vorjahresnettoumsatzerlös mindestens 60.000.000 € betrug: Der Ausgleich der Verlustvorträge ist auf 25% beschränkt.
An dieser Stelle sei aber auch an die Rechtsauskünfte der Generaldirektion Abgaben (DGT) vom 16.06.2016 und 21.04.2016 erinnert, gemäß derselben in jedem Fall der Ausgleich von Verlustvorträgen (BINS) bis zu einem Betrag von 1 Millionen Euro gestattet ist.

[value] => El Real Decreto-Ley 3/2016, de 2 de diciembre introduce importantes novedades en la Ley del Impuesto sobre Sociedades tendentes a ensanchar la base imponible de este impuesto, destacando entre las mismas la modificación del porcentaje de compensación de las BINS, estableciendo con vigencia para el año 2016 los siguientes límites respecto a la base imponible previa a la aplicación de la reserva de capitalización a la propia compensación de las BINS:
a) Para entidades cuyo importe neto de la cifra de negocios del ejercicio anterior haya sido inferior a 20.000.000, 00 Euros: La compensación de las BINS está limitada al 60% (70% en el ejercicio 2017).
b) Para entidades cuyo importe neto de la cifra de negocios del ejercicio anterior haya sido al menos de 20.000.000, 00 Euros, pero inferior a 60.000.000 Euros: La compensación de las BINS está limitada al 50%.
c) Para entidades cuyo importe neto de la cifra de negocios del ejercicio anterior haya sido al menos de 60.000.000 Euros: La compensación de las BINS está limitada al 25%
A estos efectos es conveniente recordar las consultas de la DGT de fecha 16.03.2016 y 21.04.2016, que en todo caso, se pueden compensar BINS hasta el importe de 1 millón de Euros.
