[value] => Die Problematik der zu unterschiedlichen Zwecken einsetzbaren Gutscheine, die uns meist in Form von Karten oder Geschenkboxen begegnen, und die den Empfängern die Möglichkeit geben, zwischen einer Reihe von Leistungen auszuwählen, wird im Rahmen der spanischen Umsatzsteuer (IVA) vielfach diskutiert. Die Problematik beruht im Wesentlichen darauf, ob die IVA im Augenblick des Kaufs der Karte oder Geschenkbox anfällt, oder ob im Zeitpunkt des Verwendens des Gutscheins schließlich das Gut oder die Leistung erworben wird.
Es scheint, dass das Zentrale Spanische Wirtschaftsverwaltungsgericht (TEAC) im Ergebnis die gemeinschaftsrechtliche Rechtsprechung aufgegriffen hat. Im zugrunde liegenden Fall vertreibt eine Gesellschaft ein Produkt, eine Karte, die durch ihren Inhaber zur Übernachtung in verschiedenen Hotels (sowohl in Spanien als auch im Ausland) verwendet werden kann, während die Gesellschaft die Zahlungen für diese Übernachtungen übernimmt. Der Ort des Erwerbs wird durch den Inhaber der Karte ausgewählt.
Das TEAC geht davon aus, dass der Vertrieb der Karte, da der Ort der Leistungserbringung der Übernachtungen nicht eindeutig identifiziert werden kann, einen Vorgang darstellt, der nicht der IVA unterliegt. Dies unbeschadet der Besteuerung für den späteren Erwerb der Hotelleistungen bei Vorlage der Karte in einem konkreten Hotel. In diesem Fall ist es erforderlich darauf hinzuweisen, dass der Erwerber in dem dem Gericht vorliegenden Sachverhalt die Karte in Spanien und im Ausland verwenden kann.
Sollte jedoch der Verkauf der Karte nur zum Aufenthalt in Hotels in Spanien berechtigen, fällt die Steuer im Zeitpunkt des Erwerbs der Karten oder Geschenkbox an. Dann muss, da es sich um eine Leistungserbringung handelt, die Rechnungstellung mit IVA erfolgen.

[value] => La cuestión de los bonos multiuso o bonos polivalentes, a los que comúnmente conocemos como tarjetas o cofres regalo y que permiten a los adquirentes elegir una serie de servicios a elección, ha sido un tema bastante debatido en el ámbito del IVA. La problemática básicamente estriba en saber si el IVA se devenga en el momento de la compra de la tarjeta o cofre regalo, o cuando haciendo uso de la misma adquirimos finalmente el bien o servicio.
Parece ser que el Tribunal Económico Central ha asumido finalmente la jurisprudencia comunitaria en la materia que pasamos a exponer. En el caso analizado una entidad va a comercializar un producto que consiste en una tarjeta nominativa que puede ser utilizada por su titular para el alojamiento en distintos hoteles, situados tanto en España como fuera de nuestro territorio, realizando el pago por dicho alojamiento la propia entidad. El lugar en que dicha adquisición va a efectuarse, será elegido por el portador de la tarjeta.
Sostiene el TEAC que ya que el lugar donde van a ser prestados los servicios de alojamiento que se pueden adquirir con la tarjeta no están claramente identificados, su comercialización por parte de la entidad es una operación no sujeta al Impuesto, sin perjuicio de la tributación que corresponda por la posterior adquisición de los servicios de hostelería cuando se presente la tarjeta en un hotel concreto. En este caso es necesario aclarar que el adquirente puede utilizar la tarjeta tanto en España como en el extranjero.
Ahora bien, si la venta de una tarjeta diera derecho a permanecer únicamente en hoteles situados en territorio español, se devengará el Impuesto por dichos pagos anticipados en el momento de adquisición de la tarjeta y/o cofre regalo, y habrá que proceder a la consiguiente repercusión del IVA en ese momento al tratarse de una prestación de servicios.
