[value] => In den Ausgaben Januar 2013 und Januar 2015 hatten wir bereits über die Frage berichtet, ob fehlerhafte Pflichtangaben in Rechnungen auch mit steuerlicher Rückwirkung berichtigt werden können. Von Bedeutung ist dies vor allem, wenn die Fehlerhaftigkeit im Rahmen einer späteren steuerlichen Außenprüfung festgestellt wird. Denn in einem solchen Fall könnten bei einer rückwirkenden Berichtigungsmöglichkeit auch eventuell anfallende Nachzahlungszinsen (in Höhe von 6 % p.a.) vermieden werden.
In einem am 21.12.2016 veröffentlichten Grundsatzurteil vom 20.10.2016 (V R 26/15) hat der Bundesfinanzhof (BFH) entgegen der bisherigen Praxis der Finanzverwaltung und unter Aufgabe seiner bisherigen Rechtsprechung entschieden, dass dies möglich sei. Denn die deutschen Vorschriften zum Vorsteuerabzug (§ 15 Abs. 1 Satz 1 Nr. 1 UStG sowie § 31 Abs. 5 UStDV) seien in Übereinstimmung mit dem europäischen Recht auszulegen und der Europäische Gerichtshof (EuGH) habe in der Rechtssache Senatex vom 15.09.2016 (C-518/14) die Rückwirkung der Rechnungsberichtigung nach Art. 167, Art. 178 Buchstabe a, Art 79 und Art. 226 Nr. 3 MwStSystRL bestätigt sowie die Entstehung von Nachzahlungszinsen missbilligt. Voraussetzung für die Rückwirkung sei jedoch, dass die ursprüngliche Rechnung berichtigungsfähig ist, d.h. selbst den erforderlichen Mindestanforderungen entspricht. Dies sei der Fall, wenn sie Angaben zum Rechnungsaussteller, zum Leistungsempfänger, zur Leistungsbeschreibung, zum Entgelt und zur gesondert ausgewiesenen Umsatzsteuer enthält. Hierfür reiche es aus, wenn die diesbezüglichen Angaben nicht in so hohem Maße unbestimmt, unvollständig oder offensichtlich unzutreffend sind, dass sie fehlenden Angaben gleichstehen. In der Praxis ist daher eine Rechnungsberichtigung bis zu Bestandskraft der Umsatzsteuerveranlagung möglich, in einem Streitverfahren also bis zum Schluss der mündlichen Verhandlung vor dem Finanzgericht.

[value] => En las ediciones de enero 2013 y 2015 de este boletín ya habíamos informado sobre la cuestión de si los datos obligatorios incorrectos en facturas pueden ser corregidos con efectos fiscales retroactivos. Es de especial importancia si la deficiencia se constara en una posterior inspección fiscal. En este caso puede entonces hacerse la corrección retroactivamente y podrían evitarse los intereses que se devenguen por el pago posterior (al tipo del 6% por año).
En una sentencia de fondo del 20/10/2016 (V R 26/15), publicada el 21/12/2016, el Tribunal Federal Supremo de lo Fiscal, en contra a la práctica de la administración fiscal alemana y la jurisprudencia existente, ha reiterado su posibilidad. Éste resolvió que las normas alemanas relativas a la deducción fiscal (art. 15 (1), frase 1, núm. 1 del Reglamento alemán del IVA ( UStDV)) se deben interpretar conforme al derecho Europeo y el Tribunal de Justicia de la Unión Europea (TJUE) en el asunto Senatex de 15/09/2016 (C-518/14), siendo posible la retroactividad de la corrección de facturas de conformidad con los art. 167, 178 a, 79 y 226 núm. 3 de la Directiva relativa al Sistema común del IVA de la Unión Europea, así como no considera que el cobro posterior de los intereses devengados esté en conformidad con esta Directiva. Condición para la retroactividad es, sin embargo, que la factura original sea susceptible de ser corregida, es decir, que la factura inicial contenga los requisitos mínimos necesarios. Sería el caso cuando contiene al emisor de la factura, al receptor de la operación, la descripción de la operación, el cobro y el IVA presentado por separado. Para ello es suficiente si los datos correspondientes no son tan inciertos, incompletos y manifiestamente erróneos de manera que pudieran equipararse a la misma ausencia de datos. En la práctica es posible hacer una corrección de facturas hasta que la liquidación del IVA sea firme; en un procedimiento contencioso hasta la finalización de la vista oral ante el Juzgado de lo Fiscal.
