[value] => Auch wenn die deutsche Arbeitsstättenverordnung grundsätzlich von einer Gefährlichkeit des Passivrauchens ausgeht, folgt daraus kein uneingeschränkter Anspruch auf einen rauchfreien Arbeitsplatz. So hat es das Bundesarbeitsgericht (BAG) in seinem Urteil vom 10. Mai 2016 (Rs. 9 AZR 347/15) entschieden. In dem dieser Entscheidung zugrunde liegendem Sachverhalt stritten die Parteien über die Pflicht, einen tabakrauchfreien Arbeitsplatz zur Verfügung zu stellen. Der Kläger ist Nichtraucher und arbeitet in einer Spielbank in Hessen. In dieser befinden sich drei weitgehend getrennte Räume, wobei in einem der Räume in Übereinstimmung mit den gesetzlichen Vorschriften das Rauchen gestattet ist. Der Raucherraum ist teilweise durch Türen abgetrennt und mit einer Be- und Entlüftungsanlage versehen. Hierdurch soll ein Übertreten des Rauches in die Nichtraucherbereiche vermieden werden. Der Kläger, der zeitweise im Raucherraum zum Arbeiten eingesetzt wird, verlangte die Zurverfügungstellung eines rauchfreien Arbeitsplatzes, was das BAG zurückwies.
Nach der Arbeitsstättenverordnung hat ein nichtrauchender Beschäftigter zwar Anspruch darauf, vor den Gesundheitsgefahren durch Tabakrauch geschützt zu werden. In Arbeitsstätten mit Publikumsverkehr hat jedoch der Arbeitgeber Schutzmaßnahmen nur insoweit zu treffen, als die Natur des Betriebs und die Art der Beschäftigung es zulassen. Maßgeblich ist, ob die in der Arbeitsstätte verkehrenden Personengruppen üblicherweise aufgrund der Verkehrsanschauung auch rauchen. Ist dies zu bejahen, kann der Arbeitnehmer wegen des Schutzes der Natur des Betriebs keine Veränderung oder ein faktisches Verbot der rechtmäßigen unternehmerischen Betätigung verlangen. In diesem Sinne hat das BAG entschieden, dass der Beschäftigte nicht verlangen kann, für die gesamte Spielbank ein Rauchverbot auszusprechen. Hierdurch würde der unternehmerische Tätigkeitsbereich verändert.

[value] => La normativa alemana sobre los lugares de trabajo reconoce el peligro que representa la exposición al humo del tabaco. A pesar de ello, no se reconoce a los empleados el derecho a reclamar un entorno de trabajo sin humo. Así lo ratifica el Tribunal Federal Laboral alemán (BAG) en su sentencia de 10 de mayo 2016 (9 AZR 347/15), surgida a raíz de un caso en el que se vio llamado a zanjar sobre si la empresa tenía la obligación o no de proveer un entorno de trabajo libre de humo. La parte reclamante era no fumadora y trabajaba en un casino en el Land Hessen. Tal casino disponía de tres salas separadas, en una de las cuales estaba permitido fumar, de conformidad con la normativa pública aplicable. La sala de fumadores estaba separada por puertas y disponía de un sistema de ventilación para evitar la circulación del aire desde la sala de fumadores hacia las salas de no fumadores. El empleado, que en ocasiones debía desempeñar su trabajo dentro de la sala de fumadores, reclamaba un lugar de trabajo libre de humo, reclamación que rechazó el BAG.
En efecto, la normativa legal reconoce el derecho del trabajador no fumador a protegerse contra los efectos nocivos para la salud que presenta el humo del tabaco. Ahora bien, en aquellos lugares de trabajo abiertos al público, la empresa sólo deberá implementar tales medidas de protección en la medida en que el negocio implicado lo permita y en función de la naturaleza del mismo. El factor determinante aquí lo constituye en llegar a determinar si de hecho el público que circula en el establecimiento suele fumar dentro del marco del concepto de negocio. Si tal fuera el caso, no podrá exigir el trabajador la aplicación de una prohibición de fumar, ya que ello atentaría contra el derecho de explotar el negocio de forma legal. A la luz de todo ello, pues, estimó el BAG que el empleado carecía del derecho a exigir una prohibición de fumar en todo el casino, ya que en tal caso ello hubiera alterado la naturaleza de la actividad empresarial del casino.
