[value] => Die Problematik um den gerechten Ausgleich für Privatkopie scheint kein Ende zu haben. Nach gerichtlichem hin und her und der Aufhebung der vorherigen Versuche, diese zu regulieren, hat die Regierung Anfang des Jahres einen Entwurf zur Regelung vorgeschlagen. Der o.g. Ausgleich ist ein Mechanismus zur Entschädigung von Urhebern hinsichtlich der sogenannten Beschränkung für Privatkopie. Da Erwerber von geschützten Werken das Recht haben, eine Kopie für privaten Gebrauch zu machen (beispielsweise eine Kopie der letzten Schlager CD für das Auto), ist das Ziel des Gesetzes ein System zu schaffen, in dem Urheber eine entsprechende Abfindung dafür erhalten.
Schon in 2010 wurde die spanische Regierung weltberühmt, als der Europäische Gerichtshof (EuGH) in der Entscheidung C-467/2008 die Nichtigkeit des spanischen Systems erklärte, da dieses nicht zwischen Privatpersonen oder Unternehmen unterschied. Insbesondere wurde anerkannt, dass Unternehmen nicht von diesen Regelungen betroffen sind und daher den Ausgleich nicht zu bezahlen haben, was bis dahin nicht garantiert war. 2011 beschloss der neue Kultusminister, Herr Wert, dass nunmehr der Ausgleich direkt aus dem staatlichen Haushalt zu entnehmen sei, was vom EuGH im Juni letzten Jahres wieder als nichtig erklärt worden ist (470-2014), mit erneutem Hinweis darauf, dass garantiert werden muss, dass die nicht zur Zahlung verpflichteten Personen den Ausgleich nicht bezahlen müssen. Der neue Entwurf des Gesetzesdekrets bringt das vorherige System wieder zurück, d.h., die Schaffung einer Digital-Gebühr für sämtliche Geräte und Speichermedien, welche für die Erstellung von Privatkopien tauglich sind (sowie CDs, Handys, USBs, Festplatten, usw.), was deren Preis wiederum erhöhen wird. Diesmal soll garantiert werden, dass die nicht zur Zahlung verpflichteten Personen ausgeschlossen sind, und daher soll eine Rückerstattung der Zahlungen möglich sein. Wir hoffen damit das endgültige System zu haben, obwohl es unserer Meinung nach die Entwicklungen der Unterhaltungsindustrie ignoriert, welche mit Streaming Plattformen wie Netflix, HBO, Spotify, etc. ein neues Modell geschaffen hat, in welchem die geplante Regelung schwer anzupassen ist.

[value] => La problemática de la compensación equitativa por copia privada parece no tener final. Tras idas y venidas judiciales y la anulación de todos los intentos previos de regularla, el Gobierno presentó a principios de año un nuevo borrador para su regulación. Recordar que la citada compensación es un mecanismo para resarcir a los titulares de derechos de propiedad intelectual por el denominado límite de copia privada. Es decir, dado que los adquirentes de obras protegidas tienen el derecho de realizar una copia de las mismas para uso privado (por ejemplo una copia del CD de Isabel Pantoja para el coche) el objetivo de la ley es crear un sistema que compense adecuadamente a los titulares por dicho menoscabo a sus derechos.
Ya en 2010 se hizo mundialmente famoso el Gobierno español cuando el Tribunal Europeo de Justicia (TJUE), en su decisión C-467/2008, declaró la nulidad del sistema español, al contener una regulación indiscriminada que no diferenciaba entre empresas y particulares. En concreto, reconoció que las empresas no estaban obligadas a abonar la compensación y debían quedar fuera del sistema, lo que no estaba garantizado. En 2011, el nuevo Ministro de Cultura, el Sr. Wert, decidió que en adelante la compensación sería detraída directamente de los Presupuestos Generales del Estado, lo que fue anulado por el TJUE (470-2014) en junio del año pasado, recordando nuevamente que debe garantizarse que los no obligados al pago queden fuera. El nuevo borrador de Real Decreto vuelve al sistema anterior, es decir, el establecimiento de un canon digital que gravará todo tipo de dispositivos y soportes aptos para la realización de copias privadas, tales como CD’s, móviles, USB’s, discos duros, etc. lo que volverá a encarecer dicho productos. No obstante, esta vez nos dicen que sí quedará garantizado que los no obligados queden excluidos del pago, facilitándose un sistema de devolución para éstos. Confiemos en que este sistema sea el definitivo, aunque en nuestra opinión ignora la evolución de la industria de entretenimiento que con plataformas de Streaming como Netflix, HBO, Spotify, etc. nos lleva a un nuevo modelo en el esta regulación parece no acabar de encajar.
