[value] => Der EuGH hat bereits im September 2016 entschieden, dass das Setzen eines Links auf eine fremde Internetseite eine Urheberrechtsverletzung darstellen kann. Nach der Entscheidung des EuGH (Az. C-160/15) muss derjenige, der Links mit Gewinnerzielungsabsicht setzt, prüfen, ob die verlinkten Inhalte mit Erlaubnis des Rechtsinhabers online gestellt worden sind. Kann der Linksetzer nicht nachweisen, dass er die geforderte Überprüfung vorgenommen hat, liegt mit der Verlinkung auf unbefugt im Internet verbreitete Werke eine sogenannte „öffentliche Wiedergabe“ vor. Für die unbefugte öffentliche Wiedergabe haftet der Linksetzer. Er kann beispielsweise abgemahnt und auch auf Zahlung von Schadensersatz in Anspruch genommen werden.
Kürzlich hat das LG Hamburg (Az. 310 O 402/16) die EuGH-Rechtsprechung erstmals in Deutschland angewendet. In diesem Verfahren ging es um ein unter einer Creative-Commons-Lizenz veröffentlichtes Foto. Diese Lizenz erlaubt zwar eine Online-Verbreitung, allerdings waren die Bedingungen der Lizenz nicht eingehalten, da auf Urheber- und Bearbeitungen nicht in geeigneter Weise hingewiesen worden war. Das Foto wurde daher urheberrechtswidrig online gestellt. In dem Verfahren bejahte das LG Hamburg die Haftung des Linksetzers, da dieser um die Rechtswidrigkeit des verlinkten Fotos hätte wissen müssen. Hierfür reichte es dem LG Hamburg, dass der mit Gewinnerzielungsabsicht handelnde Linksetzer es unterlassen hatte, Nachforschungen über die Rechtmäßigkeit der Verlinkung anzustellen. Dem Linksetzer wurde dabei zum Verhängnis, dass er im Verfahren selbst angegeben hatte, er habe es nicht als seine Aufgabe angesehen, die verlinkten Seiten zu überprüfen.
Die Entscheidung des LG Hamburg zeigt, wie schnell es zu einer Linkhaftung kommen kann. Unternehmen müssen verlinkte Werke auf Rechtmäßigkeit prüfen und das Ergebnis dokumentieren, um sich zu enthaften.

[value] => El TJUE decidió en septiembre de 2016 que la colocación de un link hacia una página externa puede vulnerar los derechos de autor. Según el TJUE (asunto C-160/15), quien coloca un link con ánimo de lucro tiene que comprobar si los contenidos del link han sido publicados online con el consentimiento del titular de los derechos. Si quien coloca el link no puede acreditar que ha realizado la comprobación exigida, entonces la colocación del link hacia obras distribuidas en internet sin autorización supone una así llamada “comunicación al público”. Aquel que coloca el link, responde por esta comunicación al público no autorizada. A esta persona, por ejemplo, se le puede amonestar y reclamar el pago de daños y perjuicios.
El Tribunal Regional (LG) de Hamburgo (Az. 310 O 402/16) ha aplicado recientemente por primera vez en Alemania esta jurisprudencia del TJUE. El proceso trataba sobre una foto publicada con una licencia “creative-commons”. Este tipo de licencia permite una puesta a disposición al público online, pero no se cumplieron las condiciones de la licencia, ya que no se realizaron adecuadamente las advertencias sobre autores y trabajos de edición. Por este motivo, la foto se publicó online vulnerando los derechos de autor. En este proceso judicial, el LG de Hamburgo confirmó la responsabilidad de la persona que colocó el link, ya que ésta tendría que haber sabido que las fotos a las que dirigía el link eran ilícitas. Para ello, al LG de Hamburgo le bastó saber que la persona en cuestión, que había actuado con ánimo de lucro, no había comprobado la licitud del contenido del link. Esa persona declaró al tribunal que no había considerado que fuera su tarea comprobarlo, declaraciones que le perjudicaron.
El auto del LG de Hamburgo muestra lo rápido que se puede incurrir en responsabilidad por colocar un link. Las empresas tienen que comprobar si las obras objeto de links cuentan con la autorización del titular de los derechos de autor y documentar el resultado de la comprobación.
