[value] => Im vergangenen Monat Juni hatte die Verwaltungskammer des Obersten Gerichtshofs aufgrund der durch Google eingereichten Revisionsklagen, zwei Urteile erlassen. In beiden Urteilen bekräftigt dieser die Rechtsprechung in Bezug auf die Tatsache, dass es sich bei Google Inc. um eine datenverantwortliche Stelle hinsichtlich der in Suchergebnissen beinhalteten Daten handelt. Laut dieser Interpretation ist Google Inc. das Unternehmen, welches den Zweck und Umfang der Verarbeitung der Daten innerhalb des Google Search bestimmt, ohne dass Google Spain, S.L. sich hieran beteiligt. Die Rolle von Google Spain beschränkt sich auf den Verkauf von Werbeflächen der Suchmaschinen in Spanien. Dementsprechend betont das Gericht, dass von Google Inc. die notwendigen Massnahmen gefordert werden müssen, damit das „Recht auf Vergessenwerden“ auch für die Fälle, die innerhalb dieses Services auftreten können, durchgesetzt werden kann. Ebenso wird betont, dass die Anträge gegen Google Inc., aufgrund der neuen EU-Verordnung vom 27. April 2016, von der spanischen Datenschutzbehörde (AEPD) beantragt werden.
Laut dieser Verordnung hat der Betroffene das Recht, dass ohne unangemessene Verzögerung, seine personenbezogenen Daten, die ihn betreffen, vom Datenverantwortlichen gelöscht werden, da dieser hierzu verpflichtet ist. Da das Gericht der Ansicht ist, dass Google Inc. für die Führung der Suchmaschiche verantwortlich ist, sollte auch von diesem Unternehmen die notwendigen Maßnahmen gefordert werden, um das Recht auf Vergessenwerden durchführen zu können. Jedoch wird betont, dass die Anträge von Spanien aus mittels der AEPD gestellt werden müssen. Die AEPD muss innerhalb von sechs Monaten eine Entscheidung treffen. Die Anträge kann der Betroffene direkt auf elektronischem Wege, einfach und kostenfrei übermitteln.

[value] => El pasado mes de junio, la Sala de lo Contencioso-Administrativo del Tribunal Supremo dictó dos Sentencias que tienen como objeto fallar sobre los recursos de casación interpuestos por Google. En ambas Sentencias el Tribunal Supremo reitera su jurisprudencia sobre la condición de Google Inc. y no Google Spain, S.L. como responsable del tratamiento de datos de servicio de búsquedas. Según esta interpretación, es Google Inc. quien determina los fines y medios del tratamiento de datos dentro del marco del servicio de Google Search, sin que Google Spain, S.L. participe en el mismo. La función de Google Spain se limita a promocionar en España la venta de espacios publicitarios que se generan en el buscador. En consecuencia señala, es a Google Inc. a quien debe exigirse la adopción de las medidas necesarias para hacer efectivo el “derecho al olvido” para los supuestos se produzcan dentro de ese servicio. Asimismo reitera que las reclamaciones contra Google Inc. se tramitarán desde la Agencia Española de Protección de Datos (AEPD), en aplicación del nuevo Reglamento Europeo de 27 de abril de 2016.
El nuevo Reglamento europeo establece que el interesado tendrá derecho a obtener sin dilación indebida del responsable del tratamiento, la supresión de los datos personales que le conciernan, el cual está obligado a suprimir. Como el Tribunal considera a Google Inc. como responsable de la gestión del buscador, es a quien debe exigir la adopción de las medidas para hacer efectivo el derecho al olvido. No obstante, señala que tal petición se debe formular desde España a través de la AEPD que deberá entonces dictar una resolución en el plazo de seis meses. La reclamación se puede llevar a cabo electrónicamente de manera sencilla, gratuita y directa por el interesado.
