[value] => Die spanische Kartellbehörde (CNMC) hat gegen vier Unternehmen ein Bußgeld von insgesamt 5,58 Mio. Euro wegen Verstoßes gegen Artikel 1 des Kartellgesetzes sowie Artikel 101 des Vertrages über die Arbeitsweise der Europäischen Union verhängt. Beide Bestimmungen verbieten jede Art wettbewerbsbeschränkender Handlungen im gesamten oder in Teilen des Inlands- bzw. Binnenmarktes. Die CNMC sieht es als erwiesen an, dass die betroffenen Unternehmen seit 1999 bis mind. 2014 im Rahmen der von ADIF (Betreiber der Eisenbahninfrastruktur) eröffneten Ausschreibungen für die Lieferung von Schienenumleitungen sowie weiteren Zubehörteilen untereinander Vereinbarungen sowohl bzgl. Marktaufteilung, Preise und anderen kommerziellen Bedingungen, als auch Austausch vertraulicher Geschäftsinformationen getroffen haben. Mit der Absicht, Wettbewerber auszuschalten, hätten die zuwiderhandelnden Unternehmen die Strategie angewandt, systematisch und unzulässig gemeinsame Angebote mittels der Rechtsform temporärer Unternehmenszusammenschlüsse (UTE) bei Ausschreibungen abzugeben.
Die CNMC ist der Ansicht, das rechtswidrige Verhalten habe das öffentliche Interesse insoweit geschädigt, als die von den zuwiderhandelnden Unternehmen angebotenen Preise höher waren, als sie es gewesen wären, wenn tatsächlich eine Wettbewerbssituation zwischen ihnen bestanden hätte. Schlussendlich hat die Behörde im Gleichklang mit ihrem Beschluss vom 12. Mai 2016, gegen neun Führungskräfte der geschäftsführenden Organen der zuwiderhandelnden Unternehmen, welche an der Ausübung des rechtswidrigen Verhaltens beteiligt waren, ein Bußgeld von insgesamt 65.550 Euro ausgesprochen.

[value] => La Comisión Nacional de los Mercados y la Competencia (CNMC) ha sancionado a cuatro empresas con un total de 5,58 millones de euros por una infracción del artículo 1 de la Ley de Defensa de la Competencia y del artículo 101 del Tratado de Funcionamiento de la Unión Europea. Ambos preceptos prohíben todo tipo de conductas restrictivas de la competencia en todo o parte del mercado nacional o el mercado interior, respectivamente. Según la CNMC, consta acreditado que desde el año 1999 hasta al menos 2014 se produjeron entre las empresas sancionadas, en el marco del suministro de desvíos ferroviarios y otros elementos accesorios en las licitaciones públicas convocadas por ADIF (Administrador de Infraestructuras Ferroviarias), acuerdos de reparto de mercado, de fijación de precios y otras condiciones comerciales, así como el intercambio de información comercial sensible. Las entidades infractoras, con el objetivo de eliminar la competencia, habrían utilizado una estrategia consistente en optar sistemáticamente y sin justificación alguna por presentar en las licitaciones sus ofertas de forma conjunta a través de la figura de las Uniones Temporales de Empresas (UTE).
La CNMC entiende que la conducta sancionada ha dañado el interés público en la medida en que los precios que han ofertado las entidades sancionadas son superiores a los que se habrían ofertado en el caso de haber existido competencia efectiva entre ellas. Finalmente, y al igual que ocurrió en su resolución de 12 de mayo de 2016, la CNMC ha decidido imponer una multa por un importe total de 65.550 euros a nueve directivos integrantes de los órganos de dirección de las entidades infractoras y que intervinieron en la adopción de las conductas sancionadas.
