[value] => Der BGH hat durch Beschluss vom 10.05.2016 (AZ. X ZR 66/15) für nationale Vergaben festgehalten, dass ein Hinweis auf eine Gleichwertigkeitsprüfung unter der Schwelle reicht, um Nebenangebote wertbar zu erhalten.
Die beklagte Gemeinde (G) schrieb Arbeiten nach VOB/A (Abschnitt 1) aus. Zuschlagskriterien in den Vergabeunterlagen waren nicht angegeben; im Bekanntmachungstext waren Nebenangebote zugelassen, die zum Hauptangebot qualitativ und quantitativ gleichwertig sein mussten. Im Submissionstermin war das Angebot des Bieters B das preiswerteste Hauptangebot. G gab den Zuschlag aber auf ein günstigeres Nebenangebot eines Drittbieters. B verlangte entgangenen Gewinn von G. Damit hatte B keinen Erfolg.
Der BGH hat erkannt, dass für den Bieter auf der Hand lag, dass der Zuschlag gem. § 16 Abs. 6 Nr. 3 VOB/A 2012 auf das wirtschaftlichste Angebot erteilt werden sollte, für dessen Ermittlung verschiedene Wertungskriterien in Betracht kommen. Das wirtschaftlichste Angebot ist nicht das mit dem niedrigsten Angebotspreis, sondern das mit dem besten Preis-Leistungs-Verhältnis. Die Wertung des Nebenangebotes entsprach vergaberechtlichen Maßstäben bei Vergaben unterhalb der Schwellenwerte. Die Zuschlagskriterien ließen sich objektiv bestimmen. Etwas anderes gilt nur dann, wenn ohne ausdrücklich formulierte Wertungskriterien das wirtschaftlichste Angebot nicht nach transparenten und willkürfreien Gesichtspunkten bestimmt werden kann. Durch die vorgesehene Gleichwertigkeitsprüfung für Nebenangebote wurde die Wirtschaftlichkeit bei deren Beauftragung sichergestellt.
Damit haben Auftraggeber bei nationalen Vergaben es einfacher als bei europaweiten Vergaben oberhalb der Schwelle.

[value] => El Tribunal Supremo Federal, a través de su resolución del 10/05/2016 (AZ. X ZR 66/15), ha establecido que, en las adjudicaciones nacionales, basta con indicar una evaluación de equivalencia por debajo del umbral para que una variante siga siendo susceptible de valoración.
El municipio demandado (G) sacó a concurso unos trabajos con arreglo a la parte A de la norma sobre contratación pública y adjudicación para servicios de construcción (VOB/A) (sección 1). En la documentación del concurso no se indicaron los criterios de adjudicación; en el texto publicado se admitían variantes, que debían ser cualitativa y cuantitativamente equivalentes a la oferta principal. Al finalizar el plazo de presentación, la oferta del licitador B era la oferta principal más económica. G hizo la adjudicación, pero a una variante más barata de un tercer licitador. B reclamó lucro cesante a G, pero su reclamación no prosperó.
El Tribunal Supremo Federal ha reconocido que para el licitador resultaba evidente que, de conformidad con el art. 16, párrafo 6, núm. 3 de la VOB/A de 2012, la adjudicación debía realizarse a la oferta más rentable, determinada teniendo en consideración diversos criterios de valoración. La oferta más rentable no es aquella cuyo precio sea más bajo, sino la que tenga la mejor relación calidad-precio. La valoración de la variante se realizó de conformidad con los criterios aplicables en materia de contratación pública para adjudicaciones por debajo de los valores umbral. Los criterios de adjudicación podían determinarse objetivamente. Lo contrario solo es aplicable en aquellos casos en los que, en ausencia de criterios de valoración formulados expresamente, la oferta más rentable no pueda determinarse según puntos de vista transparentes y objetivos. Con la evaluación de equivalencia prevista para variantes se garantizó la rentabilidad de la contratación.
Por ello, cuando se trata de adjudicaciones nacionales, los adjudicadores lo tienen más fácil que en las adjudicaciones europeas por encima del umbral.
