[value] => Allgemeine Faustregel ist, dass negative Besteuerungsgrundlagen mit den positiven Erlösen der nachfolgenden Steuerjahre bis zu einer Höchstgrenze von 70% der Bemessungsgrundlage (bzw. 60% im Fall von Veranlagungszeiträumen, deren Beginn in das Steuerjahr 2016 fällt), die vor der Bildung der (nicht frei verfügbaren) Kapitalisierungsrücklage bestand, ausgeglichen werden können. In jedem Fall jedoch dürfen in dem Veranlagungszeitraum Besteuerungsgrundlagen bis zu einem Betrag von einer (1) Millionen Euro ausgeglichen werden.
Allerdings findet für die im Steuerjahr 2015 begonnenen Veranlagungszeiträume nicht die vorgenannte Höchstgrenze Anwendung, sondern die im Jahr 2014 in Kraft getretene, d. h., 50% der positiven Bemessungsgrundlage, wenn der Nettoumsatzerlös in den zwölf vorangehenden Monaten über 20 Millionen Euro jedoch unter 60 Millionen Euro lag, und 25%, wenn in diesen zwölf Vormonaten der Nettoumsatzerlös mindestens 60 Millionen Euro betrug.
Neu ist demnach, gemäß zwei von der Generaldirektion für Abgaben (DGT) jeweils am 16.03.2016 und am 21.04.2016 erteilten verbindlichen Rechtsauskünften, dass in jedem Fall auch im Steuerjahr 2015 negative Bemessungsgrundlagen bis zu einem Betrag von einer Millionen Euro ausgeglichen werden dürfen.

[value] => Como regla general, las bases imponibles negativas pueden ser compensadas con las rentas positivas de los períodos impositivos siguientes con el límite del 70% (60% en períodos impositivos iniciados en 2016) de la base imponible previa a la aplicación de la reserva de capitalización. En todo caso, se pueden compensar en el período impositivo bases imponibles negativas hasta el importe de 1 millón de euros.
No obstante, para los períodos impositivos iniciados en 2015, no resulta aplicable el límite anteriormente citado, sino el límite en vigor en el año 2014: 50% de la base imponible positiva, cuando en los 12 meses anteriores el importe neto de la cifra de negocios sea al menos de 20 millones de euros pero inferior a 60 millones de euros y 25%, cuando en esos 12 meses el importe neto de la cifra de negocios sea al menos de 60 millones de euros.
La DGT en dos consultas de fecha 16.03.2016 y 21.04.2016, establece como novedad que también en el año 2015, en todo caso, se pueden compensar bases imponibles negativas hasta el importe de 1 millón de euros.
